Federal Appeals Court Finds CPS Tactic Unconstitutional

As families gather for the holidays, a recent ruling from the Ninth Circuit Court of Appeals offers hope to hundreds of thousands of parents haunted by the nightmare of unproven child abuse allegations.

For years, attorneys with Pacific Justice Institute have warned parents that, once CPS decides to investigate them for child abuse--sometimes based on anonymous tips from neighbors or vindictive ex-spouses--their names can end up on California's Child Abuse Central Index (CACI). Parents are listed on the CACI even when CPS eventually deems the charges "inconclusive" and closes its files. The CACI listing shows up on background checks for years to come and prevents parents from obtaining jobs or state licenses.

In Humphries v. County of Los Angeles, the Ninth Circuit Court of Appeals sharply criticized the ease with which people are listed on the CACI and the obstacles which prevent their names from being removed. The court was also troubled by a study indicating that as many as half of the more than 800,000 individuals listed on the CACI "may have a legitimate basis for expungement." Calling the list "the reverse of the presumption of innocence in our criminal justice system," the court ordered the state to enact greater procedural safeguards.

PJI President Brad Dacus commented, "It is gratifying that the Ninth Circuit has acknowledged what we have been saying for years--that treating parents as criminals when they are never convicted of a crime is unjust. We call on the legislature to finally fix this broken system in a way that honors basic constitutional rights."

Karen Milam, who directs PJI's Southern California office, stated, "Every year, PJI is inundated with hundreds of calls from desperate parents who do not understand how they could be labeled as child abusers based solely on unproven suspicions. This ruling is an important step toward keeping CPS honest."

There was a Connecticut Legislative Committee Task Force hearing on Fatherhood with Bill Cosby as a guest speaker December 8, 2008, at the Hartford Capitol, the Legislative Office Building, the LOB, Connecticut.

Chris Kennedy and I, Steven G. Erickson, have a desire to see Rockville Superior Court Judge Jonathan J. Kaplan removed for Connecticut Judicial Misconduct. We are going to speak and/or lodge complaints with the Connecticut Legislative Judiciary Committee. Maybe legislators will look into cases, review transcripts, and call witnesses to the judicial abuse.

Judge Jonathan J. Kaplan seems to enjoy tearing families apart and making fathers suffer as much as possible. Psychopaths and sociopaths should be screened and removed as judges.

I believe Kaplan should be removed as judge, lose his pension, be arrested, tried, jailed, and forced to pay civil damages to his victims and their children.

Enfield Connecticut Judge Howard Scheinblum

Judge Scheinblum went before the Judicial Committee to be reappointed amid all sorts of accusations of improper, and Unconstitutional behavior as a Judge. There are hundreds of stories in newspapers and other publications critical of the Enfield Connecticut Superior Court Judge.

Even with accusations of serious breaches of the law, perjury, obstruction of justice, etc., the panel reconfirmed Scheinblum for another 8 year term. What!!!???

Chris Kennedy says he had proof that the Judge committed perjury under oath at the March 21 hearing at the Capitol in Hartford.

If that Judge can be confirmed there is on bottom to Connecticut cesspool of sleaze and corruption.

Chris Kennedy of Ellington, Connecticut, stood alone against a judge that in my opinion, is one of the most blatantly arrogant, acting illegally, Unconstitutionally, and is helping retaliate against whistleblowers that try to expose Judicial, Prosecutorial, and Police Misconduct.

It is a shame that Chris Kennedy had to stand alone on your behalf, March 6, 2006, at the Judicial Hearing, Room 2C, at the Hartford State Capitol, for the whole State of Connecticut.

OPED: ‘War on Drugs’ Not Meant to Be Won

With remarks to a civic group in Enfield recently, Superior Court Judge Howard Scheinblum engaged in what is seldom forgiven in Connecticut’s public life: candor.

The judge asserted what can neither be denied nor acknowledged — that public policy on drugs doesn’t work. Speaking from his 15 years of experience on the bench, Scheinblum estimated 90 percent of criminal cases in Connecticut are connected in some way to the pursuit of illegal drugs, and he asserted that society would be far better off to let users of such drugs obtain them by prescription and to be charged for them according to their ability to pay.

Police are often too arrogant and lazy in Connecticut to do their jobs regarding helping with quality of life issues for those living in mostly downtown areas. Minorities and those that are deemed worthless, “White Trash”, or what have you, don’t get police protection and service.

The three or more important families in a Connecticut town depend on certain people being kept in their place. Putting minority kids on the right track would mean intact families and less Federal dollars for processing, arresting, and throwing the Elitists’ unwanted citizens away to prisons. Breaking up families, especially those with kids that can be labeled, “Special Needs” is another boon for Connecticut to break up families and keep unwanted citizens, down and out.

If Connecticut wasn’t making a big profit on the drug trade in taxing it as a business in confiscated assets, property, and cash of middlemen, drugs wouldn’t be selling as they now are in the criminal breeding grounds, downtown Connecticut.

The Connecticut Judiciary Committee re-appointed Judge Howard Scheinblum even though they had been informed of what is in the transcripts below. Is that conspiracy and obstruction of justice? Should members of the committee be arrested with the exception of Rep. Green?

There are judicial misconduct at every turn.

My personal beef was that a sitting Govrnor in Iowa at the time(Tom Visack) in appropriately intervened in a civil case I was involved in. Vilsack had appointed the Judge Maryann Brown. In order to come up the decision desired, the Judge abused her discreationary poweres and ignored illegal acts, damm the law, common sense, corporation documents and the Uniform Business Code.

It is our obligation to bring these things to light so that something can be done.
