Comments and analysis about the Duke/Nifong case.

The Duke lacrosse players scandal in North Carolina is playing out. There are many important issues to debate regarding this legal controversy.

What comes to light is that prosecutors can go way out of bounds and so can judges. Judicial immunity should be abolished to allow prosecutors and judges to be prosecuted and be liable civilly for their misdeeds and illegal behavior.

If individual, family, and society impact statements had to be given to juries before sentencing or the finding of guilt many would not be put in prison or fined so heavily.

Giving someone a criminal record is often a life sentence.

You may never get a decent job, most won't rent to you, you can't borrow money, and most are dating stigmas. Everyone can do a background search and even if you want to stay in a place week to week, even that is a $10 background search away. Most employers and those that rent out apartments belong to a service where background checks just cost them a membership fee.

There should be a shelf life for being charged with a misdemeanor. If you are not charged with another crime, most should be erased after 5 years.

It is too often that poorer whites and minorities are labeled criminals for life. They are separate and unequal for life.

This is not what our Forefathers intended.
