Greg Kelly, son of New York City's police commissioner, is under investigation by prosecutors and denies any wrongdoing, his lawyer said Wednesday.

NEW YORK -- The son of New York City's police commissioner Raymond Kelly is under investigation after a woman accused him of rape, sources tell NBC New York.

A source confirms a woman filed a sexual assault complaint against Greg Kelly, co-host of Fox 5’s "Good Day New York," with authorities at the 13th Precinct.

Details of her complaint are unknown at this time, but Greg Kelly has not been arrested or charged with any crime.

Kelly's attorney, Andrew Lankler, said that his client was aware of the investigation and strongly denied any wrongdoing.

"Mr. Kelly is aware that the New York County District Attorney's office is conducting an investigation. Mr. Kelly strenuously denies any wrongdoing of any kind, and is cooperating fully with the district attorney's investigation," Lankler said in a statement. "We know the district attorney's investigation will prove Mr. Kelly's innocence."

The District Attorney's office declined comment. An NYPD spokesman also declined comment, referring all questions to the district attorney.

The New York Times, quoting an anonymous law enforcement official, said the woman is in her late 20s or early 30s. She walked into the 13th Precinct with her sister after 8 p.m. on Tuesday and made her complaint, according to the Times.

The woman told police she met Kelly on the street, and the two had drinks together on Oct. 8, the paper reported. They then moved on to her office at a Lower Manhattan law firm. According to the Times, the woman told the cops that the rape occurred at the office. The two continued to keep in touch by phone and text message after the encounter.

Sources tell NBC New York Police Commissioner Ray Kelly was approached by an unknown individual at a public event who told him that his son had “ruined my girlfriend’s life.”

The police commissioner asked him to explain, but the man said he didn’t want to discuss the issue there. Ray Kelly told him to put it in writing and send it to him.

It wasn't clear if the letter was ever sent.

Greg Kelly, 43, joined Fox News Channel in 2002 and was the White House correspondent from 2005-2007, according to his biography on WNYW's website. A Marine Corps veteran and reservist, he also covered the Iraq War, including four assignments in Baghdad.

Before that, he covered politics for local cable news channel New York 1 and was an anchor and reporter for NewsChannel 34, an ABC and NBC affiliate in Binghamton, N.Y., his bio said.

He also served for nearly a decade in the Marine Corps and is now a lieutenant colonel in its reserves.

Might want to get your Encyclopedia Britannica set out of storage: Wikipedia will go dark Wednesday, joining a growing number of popular websites staging an online revolt against two anti-piracy bills.

Founder Jimmy Wales made the announcement in tweets on Monday, telling followers his goal is to "melt phone systems in Washington" in opposition to the Stop Online Piracy Act in the House and the PROTECT IP Act in the Senate.

The online protest puts Wikipedia in the company of other websites such as Reddit and popular games such as Minecraft in leveraging its substantial size and clout to campaign against the bills. Wales suggested on Twitter the impact of the blackout could be significant, given that "comScore estimates the English Wikipedia receives 25 million average daily visitors globally."

The site began weeks ago soliciting input from users on whether to implement a full or partial blackout of Wikipedia. Wales said Monday that the protest will involve only the English site.

"Final details under consideration but consensus seems to be for 'full' rather than 'soft' blackout!," he tweeted.

More details are due later this evening, according to Wikipedia.

The debates over SOPA and PIPA are drawing even some of the most politically averse Internet companies into the Washington fray. They argue the bills would threaten the architecture of the Internet by giving copyright holders and federal law enforcement too much power to shut off access to foreign websites peddling movies, music and other illegal content.

Responding to overwhelming criticism, the leading authors of SOPA and PIPA — House Judiciary Chairman Lamar Smith (R-Texas) and Senate Judiciary head Patrick Leahy (D-Vt.) — abandoned provisions that would allow the feds to seek a court order to block domain names of such sites.

Senate Majority Leader Harry Reid (D-Nev.) has scheduled a critical Jan. 24 cloture vote on PIPA. And during an appearance on NBC's "Meet the Press" Sunday, Reid showed no sign of backing down, though he did call for opposing sides to compromise.

Internet companies say the removal of the domain name-blocking provisions isn't enough. Buoyed by a statement from the White House Saturday that criticized parts of the House and Senate bills without explicitly opposing the measures, Wikipedia vowed to join the online assault against SOPA and PIPA this week.

"Student warning! Do your homework early," Wales tweeted. "Wikipedia protesting bad law on Wednesday!"

West Point graduate and Iraqi war veteran Antonio Buehler also appears to discuss his harrowing treatment & arrest on New Year's Eve in Austin, TX after he simply recorded video of what he considered to be police mistreatment of a woman being arrested at a gas station. Buehler gives his take on why he was arrested for 'harassment of a public servant' — a third degree felony after police claimed he was interfering with the DUI suspect already in the process of being arrested. He is currently gathering witness of the event-- including those who recorded video-- to build his case.

Antonio Buehler, 34, was stopping for gas on his way home early Sunday morning when he and his friend heard a woman scream. "We look over, and we see the cop violently yanking the female out of the car," Buehler told KVUE. As seen on the video -- taken by a cell phone from across the street -- the woman had her hands pulled straight out behind her back. Buehler said, "It just looked extremely painful."

Buehler began taking pictures of the scene, which caught the attention of the officers. Officer Oborski approached Buehler and accused him of interfering with the investigation before pushing him into the white truck seen on the video. Buehler was then taken to the BAT (Breath Alcohol Test) bus and asked to take a breathalyzer. Buehler was the designated driver that morning and had not been drinking.

According to APD spokesman, Corp. Anthony Hipolito, it was likely Oborski took Buehler to the BAT bus in order to complete paperwork on the DWI arrest. However, when Hipolito was asked to provide the reason Buehler was requested to take a breathalyzer he responded with, "I don't know."

It may have looked like they were ready for war or some deranged person looking for his late Social Security benefits.

But it was only Federal Protective Service officers with the U.S. Department of Homeland Security who were conducting a random training operation early Tuesday morning when they surprisingly showed up at the Social Security Administration office in downtown Leesburg.

With their blue and white SUVs circled around the Main Street office, at least one official was posted on the door with a semiautomatic rifle, randomly checking identifications. And other officers, some with K-9s, sifted through the building.

"I thought someone was upset about not getting there check," said Laura Kelly, who took a friend to the office on Tuesday.

According to one Homeland official in the Washington, D.C. office, Operation Shield. is an effort that uses routine, unannounced visits by FPS inspectors to test the effectiveness of contract guards, or protective security officers -- "detecting the presence of unauthorized persons and potentially disruptive or dangerous activities."

Attorney Charges Breach Of Privacy In D-SNAP

By CHRISTOPHER KEATING

HARTFORD (Connecticut)—

An attorney for state employees is charging that the administration of Gov. Dannel P. Malloy made a "huge breach of privacy'' involving the release of the Social Security numbers of state employees who are under investigation for food stamp fraud.

The names were included on a subpoena and were released to other state employees who are also under investigation for possibly falsifying their finances in order to qualify for emergency food stamp benefits following Tropical Storm Irene. The information was part of a sweeping subpoena for bank account records at Wells Fargo/Wachovia Bank as investigators are trying to determine whether state employees misstated the amount of money they had in the bank at the time.

Instead of a separate subpoena for each individual, the omnibus subpoenas from the Department of Social Services had dozens of names on a single document, said attorney Rich Rochlin, who represents state employees who face possible firing for food stamp fraud. As a result, state employees who are under investigation could not only learn that their fellow employees were under investigation - but could also see the listing of their Social Security number.

"This is amateur hour,'' Rochlin told reporters Tuesday during a news conference at his office. "This is incompetence at the highest levels.''

But Andrew McDonald, the chief legal counsel for Malloy, said that it was Wells Fargo - not the Malloy administration - that released the information.

Citing section 36a-43a of Connecticut state law that deals specifically with subpoenas by the Department of Social Services, McDonald said, "There was no obligation for Wells Fargo to notify the customer. If [Rochlin] has a gripe with anybody, it's with Wells Fargo. They did not have to consult with us.''

McDonald added, "That's not our fault. If Wells Fargo sent that information to other people, we're responsible for that?''

Overall, 130 names appear on the subpoenas, including many state employees. Some of the names appear to be the dependents of state employees, who were named on the D-SNAP applications. One subpoena had about 90 names and another had about 40 names, Rochlin said.

The state law cited by McDonald is as follows:

a) Except as provided in section 36a-44, a financial institution shall disclose financial records pursuant to a lawful subpoena, summons, warrant or court order served upon it if the party seeking the records causes such subpoena, summons, warrant or court order or a certified copy thereof to be served upon the customer whose records are being sought, at least ten days prior to the date on which the records are to be disclosed, provided a court of competent jurisdiction, for good cause, may waive service of such subpoena, summons, warrant or court order, or certified copy thereof, upon such customer. If such subpoena was issued by the Commissioner of Administrative Services or the Commissioner of Social Services pursuant to section 17b-137, 17b-452 or 17b-454, service of such subpoena upon the customer shall not be required.

The final sentence of that subsection shows that Wells Fargo was not obligated to notify the customer, McDonald said.

But Rochlin rejected that interpretation.

"The problem with that is the bank can't pick and choose which part of a subpoena they send to you,'' he said. "It's not the bank's fault. It has no duty to go through it and cherry-pick it. The state should have a separate subpoena for each individual. Your account agreement says that 'if we are subpoenaed to provide your records, we will notify you of that.' They are subject to federal rules that preempt state law.''

The state law cited by McDonald also states:

(c) A financial institution shall disclose financial records pursuant to a certificate, signed by the Commissioner of Administrative Services or the Commissioner of Social Services in accordance with the provisions of section 36a-42, or pursuant to an agreement with the IV-D agency under subsection (c) of section 17b-137.

(d) No such financial institution shall be held civilly or criminally responsible for disclosure of financial records pursuant to a certificate, subpoena, summons, warrant or court order which on its face appears to have been issued upon lawful authority.

A Wells Fargo spokeswoman said that the bank had just heard about the issue Tuesday, and she referred questions to another spokesman. He said he would likely be unable to comment until Wednesday morning.

"I am now in possession of evidence that, in the process of subpoenaing records belonging to D-SNAP applicants, the Malloy administration disclosed the names and Social Security numbers of all D-SNAP recipients who maintain bank accounts at Wells Fargo/Wachovia Bank to each other,'' Rochlin said earlier in a statement Tuesday. "This negligence is indicative of the way in which the D-SNAP program was run from the start. This act also constitutes numerous violations of state and federal laws and regulations as well as a violation of uncharged applicants' Constitutional rights to due process.''

Rochlin added, "This is the exact reason why the D-SNAP investigation needs to be taken away from DSS and placed into the hands of an independent agency or the federal government. The Malloy administration has now proven, beyond a shadow of a doubt, that it is incapable of conducting this investigation in a manner that ensures the due process and privacy of those being investigated. This incident has forced me to call on the Human Services Committee to hold an emergency hearing about the D-SNAP process and the ongoing investigation.''

Rochlin held a news conference at 4 p.m. at his office in Berlin that included reporters patched in on speaker phone.

"As a result, everyone knows who is being investigated,'' Rochlin told reporters. "We are calling upon the Governor's office to immediately pull this investigation from the Department of Social Services. ... How can we expect them to conduct this in a far and honest way?''

Two of Rochlin's clients had hearings last week about possible firings, but they have not heard the official results yet.

"Social Security numbers are private information. That could lead to identity theft,'' Rochlin told reporters. "More importantly, now their privacy has been violated. ... We cannot accept this type of behavior by this administration. It needs to be stopped. ... The governor needs to put an end to this now.''

In another twist, the subpoeana was signed by high-level DSS employee Craig Zimmerman on behalf of Michael Starkowski, who has since been replaced by Commissioner Roderick Bremby. Bremby was selected by Malloy and appeared with him on a Sunday afternoon at the state Capitol when the food stamp fraud investigation was announced.

"How does Craig Zimmerman sign subpoeanas on behalf of commissioners who are no longer there?'' Rochlin asked.

"The state almost always has a separate subpoena for each particular request,'' he said.

Sen. Joseph Markley, the ranking Senate Republican on the human services committee, said the emergency food stamp program has been a problem from the start.

"If DSS was running their programs well, we would not have had these problems with the D-SNAP program,'' Markley told Capitol Watch Tuesday in a telephone interview. "The evidence of the poor management was there because of the lines, because of the confusion. The governor's office has gone into this mystifying mode of dribbling bits of the investigation. ... There's been perhaps an effort to make the story: 'state employees break the law' instead of 'Department mismanages program.' ''

He added, "It raises the question of how programs are being run by DSS. In the end, DSS should not be investigating itself. It was a chaotic program, and now it seems to be a rather chaotic investigation. If it clears itself, it doesn't disperse the cloud as if'' an outside, independent agency conducted it.

He added, "It sounds like a terrible mistake.''

Markley said he will speak to his fellow leaders on the human services committee, including Senate chairman Anthony Musto of Trumbull and Rep. Peter Tercyak of New Britain.

"He's a few degrees to my left ideologically, but we get along,'' Markley said of Tercyak. "We're both true believers in a sense. We're kind of idealists of two different casts.''

Markley laughed out loud upon hearing that Zimmerman had signed the subpoena on behalf of DSS Commissioner Starkowski, a well-known state employee who has long since retired.

"How long ago did Starkowski leave?'' Markley asked rhetorically. "I hope that things are not so bad that DSS has form subpoenas. You would think there would be a little proofreading. Proofreading is a thing of the past.''

It has also emerged that the FBI lied about mobile phone tracking software, after assuring Congress that it had not sought out data from Carrier IQ when the firm says otherwise. The IQ Agent software has been shown to log keystrokes and messages sent by smartphones.

On January 21, 2010, with its ruling in Citizens United v. Federal Election Commission, the Supreme Court ruled that corporations are persons, entitled by the U.S. Constitution to buy elections and run our government. Human beings are people; corporations are legal fictions.

We, the People of the United States of America, reject the U.S. Supreme Court's ruling in Citizens United, and move to amend our Constitution to firmly establish that money is not speech, and that human beings, not corporations, are persons entitled to constitutional rights.

The Supreme Court is misguided in principle, and wrong on the law. In a democracy, the people rule.

What do the Statue of Liberty, Independence Hall, and Monticello have in common? The average American with a smattering of historical knowledge might say that those historic sites are all symbolic of America’s unique heritage of freedom.

Monticello, of course, was the home of Thomas Jefferson, the author of the Declaration of Independence. That document (as well as the U.S. Constitution, later) was signed in Independence Hall. The Statue of Liberty memorializes the free nation under God that those founding documents created.

What about the Great Smoky Mountains, Yellowstone Park, and the Grand Canyon? Well, these priceless natural resources are all managed by the U.S. National Parks Service. They are among the most frequently visited natural recreation areas in America, where millions of American families vacation every year.

Would it surprise you to learn that every one of these unique American landmarks is also controlled by the United Nations? It’s amazing but true. Every one of the natural and historic treasures listed above – plus more than a dozen more in America – has been designated an official World Heritage Site by the United Nations Educational, Scientific and Cultural Organization (UNESCO), which is headquartered in Paris, France.

Sites included in the World Heritage program are considered to have “outstanding universal value” as part of our common world heritage. They are designated as protected areas under the 1972 World Heritage Treaty, which is itself an outgrowth of the 1968 UNESCO Biosphere Conference where the currently ubiquitous concept of “sustainable development” first saw the light of day.

But, wait there’s more. There are 47 OTHER locations in America designated as UN Biosphere Reserves, which are vast parcels of land set aside for conservation and scientific study. Symbolized by the Egyptian ankh, the UN’s Man and Biosphere program is designed to help humans achieve a “balanced relationship with the natural world” again, through “sustainable use”of natural resources.

Button, button, who’s got the button?

What does this mean in real life? Well, nothing, if you believe the UN. “Biosphere Reserves have no international or other authority,” claims the website of the U.S. MAB program. Their list of common “myths” about MAB includes denials that the program results in any “loss of sovereignty” or threat to private property.

Others see it differently. Henry Lamb, executive vice president of the Environmental Conservation Organization and chairman of Sovereignty International, says that the “Operational Guidelines” developed by the UN are effectively enforced by the U.S. government agencies managing the sites locally.

“Neither Congress, nor any state legislature, has ever voted to approve any of the 47 UN Biosphere Reserves in the United States. The management policy for millions of acres covered by these reserves is crafted by international committees of bureaucrats, none of whom is elected. To comply with ‘international obligations,’ the United States conforms its management policy and, in some cases. its law to accommodate the wishes of bureaucrats that are completely unknown to the people who are governed by the policies,” Lamb insists.

“This reality is but a hint of what is in store for those governed by the rule of international law. Massive documents, such as the 1140-page ‘Global Biodiversity Assessment,’ the 300-page ‘Agenda 21,’ and the 410-page ‘Our Global Neighborhood,’ all paint a picture of the international law that is being devised to govern the world in the 21st century.” (For more information visit www.eco.freedom.org .)

The core of the buffer zone is the transition area

Every Biosphere Reserve site consists of a protected CORE area, set aside strictly for conservation; a surrounding BUFFER ZONE, with limited human activity allowed; and a larger TRANSITION area, where otherwise legal human use may be severely restricted when the site is judged to be “in danger.”

For example, in 1995, Bill Clinton got the UN to declare Yellowstone Park a “World Heritage Site in Danger.” That gave him the “international obligation” to close down a coal mine on private property three miles away despite the fact that coal had been mined in the area for 150 years before Yellowstone Park was created, and the Crown Butte Mines had won an award for excellence in 1992.

Today, Yellowstone Park is still considered to be “in danger,” according to the UN, because of “year-round visitor pressure.” Too many U.S. tourists taking their kids to see Old Faithful, the global bureaucrats in Paris say.

The President has the sole authority to approve these UN designations. Congress has no oversight, and average American citizens have no input. The House of Representatives has twice passed a bill requiring Congressional approval before any more precious pieces of America can be designated either Biosphere Reserves or World Heritage sites. So far, the Senate has refused to even bring the measure up for a vote.

Call me old-fashioned, but I still think Americans ought to control American land, not UNESCO bureaucrats. Why are both Republicans and Democrats, Liberals and Conservatives, allowing the UN to wield this kind of influence inside our nation’s borders? U.S. taxpayers should be outraged!

I've contacted Vermont US Senators Patrick Leahy and Bernie Sanders on [these issues] and about remedying my case of suffering judicial abuse and police misconduct in the State of Connecticut for my having thought that the 1st Amendment was protected in the United States of America. Leahy and Sanders have gotten word to me that they won't interfere with the Executive or Judicial Branches. The Executive and Judicial Branches are preventing citizens from getting representation for their taxation in the Legislative Branch.

Hartford Connecticut Narcotics Detective Richard Murzin [story and photo] allegedly interfered with organized crime heroin and crack cocaine dealing against his captain's wishes. He, and his family then suffered decades of police harassment and judicial abuse. Rich Murzin passed away not seeing any justice for his family, or himself. What does that say about America and its pretend justice system?

In December 1996, Ritt Goldstein hosted a Connecticut judiciary committee special legislative hearing on the subject on the need for civilian oversight of police. Ritt fled the US, so terrorized by police, to seek political asylum in Sweden. This Ritt Goldstein video is documentation of police brutality and judicial misconduct that is even more present in the US today. If there were actual justice in the US, Connecticut state legistlators and my Vermont US Senators, Leahy and Sanders, would be asking what happened to Ritt Goldstein and what could prevent such citizen abuse in occurring in the present and future. They would also be looking at what happened to Rich Murzin and then be asking what can now be done for his family.

So, how about it, why not have victims, and those who offer solutions, for America's current police state, testify at a special hearing at the US Senate?

Speak out, get squashed in the USA. It shouldn't be that way, right Senators?

Former Minnesota Governor Jesse Ventura said he would now refer to the country of his birth as the "Fascist States of America" after a judge dismissed his case challenging airport pat downs, adding that his only recourse now would be to run for President.

"Ventura made his comments outside the federal courthouse in St. Paul, where in January he sued to challenge the Transportation Security Administration's (TSA) airport security procedures," reports the Minneapolis Star Tribune. "The suit was thrown out because Congress set up the law so that all such challenges must be brought directly in Circuit Courts of Appeals, wrote U.S. District Judge Susan Richard Nelson."

"They said they don't have jurisdiction," Ventura told reporters. "Well my question is if the federal courts don't have jurisdiction over a constitutional question then who the hell does?"

A further detail that Ventura revealed on the Alex Jones Show which has not been picked up by mainstream media reports is the fact that Ventura's lawyer was told he could not even look at the ruling due to "national security" concerns.

Speaking to the Alex Jones Show today, Ventura spoke of his fury about how an American citizen was not even allowed to go to court to defend the Bill of Rights, adding that from now on he would refer to the U.S. as the "Fascist States of America" and would refuse to stand for the national anthem.

Vowing to "never fly commercial" again, Ventura gave a passionate press conference today, expressing his anger at TSA grope down procedures that force people like himself with metal implants to go through humiliating pat downs every time they pass through airport security.

NEW YORK — The arresting officer came by the cell, Samantha Zucker said, to make snide remarks about finding her with a friend in Riverside Park after its 1 a.m. closing.

For instance:

“He was telling me that I needed to get a new boyfriend, that I should get a guy who takes me out to dinner,” Ms. Zucker said. “He mocked me for being from Westchester.”

Early in the morning on Oct. 22, a Saturday, Ms. Zucker, 21, and her friend Alex Fischer, also 21, were stopped by the police in Riverside Park and given tickets for trespassing. Mr. Fischer was permitted to leave after he produced his driver’s license. But Ms. Zucker, on a visit to New York City with a group of Carnegie Mellon University seniors looking for jobs in design industries, had left her wallet in a hotel two blocks away.

She was handcuffed. For the next 36 hours, she was moved from a cell in the 26th Precinct station house on West 126th Street to central booking in Lower Manhattan and then — because one of the officers was ending his shift before Ms. Zucker could be photographed for her court appearance, and you didn’t think he was going to take the subway uptown while his partner stayed with her at booking, did you? — she was brought back to Harlem.

There she waited in a cell until a pair of fresh police officers were rustled up to bring her back downtown for booking, where she spent a second night in custody.

The judge proceeded to dismiss the ticket in less than a minute.

News about the Police Department lately could run under the headline of the daily Dismal Development, starting with a judge declaring Tuesday that an officer was guilty of planting drugs on entirely innocent people and continuing back a few days to gun-smuggling, pepper-spraying and ticket-fixing.

Here, in the pointless arrest of Ms. Zucker, is a crime that is not even on the books: the staggering waste of spirit, the squandering of public resources, the follies disguised as crime-fighting. About 40,000 people a year — the vast majority of them young black and Latino men — are fed like widgets onto a conveyor belt of arrest, booking and court, after being told to empty their pockets and thus commit the misdemeanor of “open display” of marijuana.

Such arrests are a drain on the human economy.

Ms. Zucker said that throughout her stay in police station cells, other officers were shocked that she had not been given a chance to have a friend fetch her ID. “The female officers were gossiping that the officer who arrested me had an incredibly short fuse,” she said.

We are instructed by the mayor that the garish crimes of police gun-running and fake arrests are the work of rogues, not the daily toil of honest police officers. A fair point — but no more than Ms. Zucker’s observations of spiritual corruption.

“While it may have been one out-of-control officer that began the process,” she said, “no other officer had the courage to stand up against what they knew was a poor decision.”

After two days of storming design firms around the city with about 80 classmates, Ms. Zucker stopped at the hotel near West 103rd Street where the group was staying so she could drop off the bag she had been schlepping. Then she got Mr. Fischer — a classmate, not a boyfriend, the leering remark of the police officer to the contrary — to walk with her a few blocks to the park, at about 3 a.m. They wanted to see the Hudson River, which runs past her hometown of Ardsley, N.Y.

“We’re there five minutes when a police car came up and told us we had to leave because the park was closed,” Mr. Fischer said. “We said, ‘O.K., we didn’t know,’ and turned around to leave. Almost immediately, a second police car pulls up.”

Its driver said they would get tickets for trespassing and demanded their IDs. Ms. Zucker suggested that someone could bring her papers from the hotel. “He said it was too late for that, I should have thought of it earlier,” she said.

Asked about the policy, the Police Department’s chief spokesman, Paul J. Browne, said officers can allow a friend or relative to retrieve ID. He did not say if a supervisor approved the arrest of Ms. Zucker, which was attributed in court papers to a Police Officer Durrell of the 26th Precinct.

Twice, she said, the officer told her not to call him by a specific foul term.

“I said, ‘Sir, I never used that word.’ ”

No doubt he was hearing things: the unspoken truth about his unspeakable actions.

I did in the State of Connecticut where police are famous for retaliation and brutality. White male Connecticut State Police in Stafford Springs, Connecticut, put a pizza shop owner out of business because he wasn't White, and because the owner brought White girls the officers thought they should have first dibbs on up into an apartment above the pizza shop.

I was bounced off my own aluminum siding in Stafford Springs, Connecticut, because I believe Stafford Constable "Fat Frank" Prochaska thought he could maybe arrest me and then get my wife. He did arrest me for having my ear bitten by a drug dealer who I didn't want dealing cocaine near my property, or neighbors.

The drug dealer repeatedly punched me in the face and then fled the scene after I dialed 911. Officer Prochaska was willing to arrest only me and with no record I faced a year and a half in prison, no deals. Enough on my story.

Police can rape women and get away with it. They can use your tax dollars to pay informants to beat you up, set you up for property, business loss, break up of your family, and your being railroaded to prison. Been there, done that.

Should police decide they want to have sex with, or date, your partner and then arrest you, or your partner, if they don't get what they want?

Should police be interfering in your personal life?

Whether you have suffered in the Connecticut kangaroo court system, or in any other state, it is worth a look. The general theme is official kidnapping of children, Department of Children and Families DCF, public corruption, police brutality and misconduct, judicial abuse, judge and attorney misconduct, and networking with others likewise abused to hopefully get results.

America would not be in at least 3 wars of illegal occupation and would not be in such a financial mess if the court system represented the people, not greedy lawyers, on the take judges, offshore corporations, banksters, and profiteers of wars and heroin and cocaine smuggling.

Let's take back our own country. Let's reform the courts and make investigation of elected and other criminals, independent and unbiased. The people of the US don't seem to be represented for their taxation. Big Pharma, banksters, military contractors, and offshore corporate pirates seem to operate US courts, policing, and the US Government. Look at what they do, not what they say. FDA Kidnaps and Deports Herbalist Greg Caton

The U.S. Food and Drug Administration today stands accused of taking part in the kidnapping and illegal extradition of a permanent resident of Ecuador, in violation of both international law and Ecuadorian law.

Greg Caton, owner and operator of Alpha Omega Labs (www.AltCancer.com), an herbal products company that sells anti-cancer herbal remedies made with Ecuadorian medicinal herbs, was arrested at gunpoint at a road checkpoint in Ecuador, then transported to an Ecuadorian holding facility to await a hearing on December 14, 2009. Caton was expected to be set free by the Ecuadorian judge at that hearing based on the facts of the case which indicated Caton's permanent residency in Ecuador is legal and valid.

Three days before the hearing could take place, Caton was taken from his holding facility and, with the help of U.S. State Department employees, involuntarily placed on an American Airlines plane headed for Miami. An Ecuadorian judge rushed to the airport in Guayaquil and demanded that Caton be released from the plane, stating that the attempted deportation was illegal, but American Airlines employees reportedly refused to allow Caton to leave the plane, stating that the plane was "U.S. territory" and that Ecuadorian law did not apply there (even though the plane was still on the tarmac in Guayaquil and under the direction of the air traffic control tower there).

The plane then departed Guayaquil and continued its flight to Miami where Greg Caton was held in a federal detention facility to await trial in the U.S.

Extrajudicial killing

An extrajudicial killing is the killing of a person by governmental authorities without the sanction of any judicial proceeding or legal process. Extrajudicial punishments are by their nature unlawful, since they bypass the due process of the legal jurisdiction in which they occur. Extrajudicial killings often target leading political, trade union, dissident, religious, and social figures and may be carried out by the state government or other state authorities like the armed forces and police.

Extrajudicial killings and death squads are common in the Middle East (mostly in Palestinian territories (Israel) and Iraq^[1]^[2]^[3]^[4]^[5]), Central America,^[6]^[7]^[8] Afghanistan, Bangladesh,^[9] Pakistan, Sri Lanka,^[10] several nations or regions in Equatorial Africa,^[11]^[12]^[13] Jamaica,^[14]^[15]^[16] Kosovo,^{[citation needed]} parts of South America,^[17]^[18]^[19] allegedly Russia,^[20] Uzbekistan, parts of Thailand,^[21]^[22] and in the Philippines.^[22]^[23]^[24]^[25]^[26]^[27]^[28] One of the earliest cases of extrajudical killings was in the Weimar Republic of Germany.^[29]

Cold war usage

The former Soviet Union and Communist Bloc countries used to kill dissidents extrajudicially during the 1930s. Nguyễn Văn Lém (referred to as Captain Bay Lop) (died 1 February 1968 in Saigon) was a member of the Viet Cong who was summarily shot in Saigon during the Tet Offensive. The photograph of his death would become one of many anti-Vietnam War icons in the Western World.

During the 1960s and throughout the 1970s, death squads were used against the Viet Cong cadre as well as supporters in neighbouring countries (notably Cambodia). See also Phoenix Program (also known as Phung Hoang). The Viet Cong also used death squads of their own against civilians for political reasons.

Argentina used extrajudicial killings as way of crushing the liberal and communist opposition to the military junta during the 'Dirty war' of the late 1960s and most of the 1970s. Alianza Anticomunista Argentina was a far-right death squad mainly active during the "Dirty War". The Chilean Junta of 1972 to 1992 also committed such killings; see Operation Condor for examples.

During the Salvadoran civil war, death squads achieved notoriety when far-right vigilantes assassinated Archbishop Óscar Romero for his social activism in March 1980. In December 1980, three American nuns, Ita Ford, Dorothy Kazel, and Maura Clarke, and a lay worker, Jean Donovan, were raped and murdered by a military unit later found to have been acting on specific orders. Death squads were instrumental in killing hundreds of peasants and activists, including such notable priests as Rutilio Grande. Because the death squads involved were found to have been soldiers of the Salvadoran military, which was receiving U.S. funding and training from American advisors during the Carter administration,^[6] these events prompted outrage in the U.S. and led to a temporary cutoff in military aid from the Reagan administration^{[citation needed]}, although Death Squad activity stretched well into the Reagan years (1981–1989) as well.

Honduras also had death squads active through the 1980s, the most notorious of which was Battalion 316. Hundreds of people, including teachers, politicians and union bosses, were assassinated by government-backed forces. Battalion 316 received substantial support and training from the United States Central Intelligence Agency.^[30]

Iran

During the 1950s a regime was put in power through the efforts of the CIA, in which the Shah (hereditary monarch) used SAVAK death squads to kill thousands. After the revolution death squads were used by the new regime. In 1983 the CIA gave one of the leaders of Iran Khomeni information on KGB agents in Iran. This information was probably used.The Iranian regime later used death squads occasionally throughout the 1970s, 1980s, and 1990s however by the 2000s it has appeared to almost entirely if not all cease their operation. This partial Westernization of the country can be seen paralleling similar events in Lebanon, United Arab Emirates, and Northern Iraq beginning in the late 1990s

Iraq

Iraq was formed by the partition and domination of various tribal lands by the British in the early 20th century. Britain granted independence to Iraq in 1932, on the urging of King Faisal, though the British retained military bases and transit rights for their forces. King Ghazi of Iraq ruled as a figurehead after King Faisal's death in 1933, while undermined by attempted military coups, until his death in 1939. The United Kingdom invaded Iraq in 1941 (see Anglo-Iraqi War), for fear that the government of Rashid Ali al-Gaylani might cut oil supplies to Western nations, and because of his links to the Axis powers. A military occupation followed the restoration of the Hashemite monarchy, and the occupation ended on October 26, 1947. Iraq was left with a national government led from Baghdad made up of Sunni ethnicity in key positions of power, ruling over an ad-hoc nation splintered by tribal affiliations. This leadership used death squads and committed massacres in Iraq throughout the 20th century, culminating in the dictatorship of Saddam Hussein.^[31]

The country has since become increasingly partitioned following the Iraq War into three zones: a Kurdish ethnic zone to the north, a Sunni center and the Shia ethnic zone to the south. The secular Arab socialist Baathist leadership were replaced with a provisional and later constitutional government that included leadership roles for the Shia and Kurdish peoples of the nation. This paralleled the development of ethnic militias by the Shia, Sunni, and the Kurdish (Peshmerga).

There were death squads formed by members of every ethnicity.^[32] In the national capital of Baghdad some members of the now-Shia police department and army (and militia members posing as members of police or armed forces) formed unofficial, unsanctioned, but long-tolerated death squads.^[33] They possibly have links to the Interior Ministry and are popularly known as the 'black crows'. These groups operated night or day. They usually arrested people, then either tortured^[34] or killed ^[35] them.

The victims of these attacks were predominantly young males who had probably been suspected of being members of the Sunni insurgency. Agitators such as Abdul Razaq al-Na'as, Dr. Abdullateef al-Mayah, and Dr. Wissam Al-Hashimi have also been killed. These killings are not limited to only men; women and children have also been arrested and/or killed.^[36] Some of these killings have also been simple robberies or other criminal activities.

A feature in a May 2005 issue of the magazine of theNew York Times claimed that the U.S. military had modelled the "Wolf Brigade", the Iraqi interior ministry police commandos, on the death squads used in the 1980s to crush the left-wing insurgency in El Salvador.^[37]

Western news organizations such as Time and People disassembled this by focusing on the aspects such as probable militia membership, religious ethnicity, as well as uniforms worn by these squads rather than stating the United States-backed Iraqi government had death squads active in the Iraqi capital of Baghdad.^[38]

Israel

The Mossad has been suspect for a series of extrajudicial execution sometimes committed abroad with alleged complicity of other government officials.^{[citation needed]} The organisation has recently been blamed for the killing of Mahmoud al-Mabhouh, 49, a Hamas commander, in Dubai.^{[citation needed]}

Philippines

Main article: Extrajudicial killings and forced disappearances in the Philippines

The Philippines has had its share of extrajudicial atrocities and related political violence as well, the most recent being the Maguindanao massacre in Mindanao (November 2009). The Committee to Protect Journalists (CPJ) has called the massacre the single deadliest event for journalists in history.^[39] Even prior to this, the CPJ had labeled the Philippines the second most dangerous country for journalists, second only to Iraq.^[39]

Thailand

Reportedly thousands of extrajudicial killings occurred during the 2003 anti-drug effort of Thailand's prime minister Thaksin Shinawatra.

Rumors still persist that there is collusion between the government, rogue military officers and radical right wing/ anti-drugs death squads.^[40] [3]^[41]^[42]^[43][4][5]^[44]

Both Muslim^[45] and Buddhist ^[46] sectarian death squads still operate in the south of the country.

United Kingdom (UK)

During the Irish war of independence in 1916–21, the British forces organised several secret assassination squads. In 1920 alone the Royal Irish Constabulary Reserve Force murdered the mayors of Limerick and Cork cities. In Limerick, the replacement mayor was also murdered, while in Cork, the new mayor died after a 74 day hunger strike.^{[citation needed]}

Northern Ireland

Main article: Shoot-to-kill policy in Northern Ireland

In Northern Ireland, various paramilitary groups and members of the British armed forces and the Royal Ulster Constabulary killed without lawful excuse during The Troubles.^[47]^[48] During the 30 years of The Troubles in Northern Ireland, both nationalist and loyalist paramilitary forces organised assassination squads. Notable cases include Brian Nelson, an Ulster Defence Association member and British Army agent convicted of sectarian murders.^[49]^[50]^[51]

United States

In 1934, a group of six law officers ambushed the outlaw couple Bonnie and Clyde, and opened fire with automatic weapons and shotguns.^[52] Since that incident, it has become standard procedure for law officers to order suspects to halt or stop.^{[citation needed]} Laws in the U.S. continue to be reviewed and revised, and agents are monitored in a system of internal checks and balances coupled with citizens' advocacy groups, to minimize the possibility that government officials will exceed their lawful authority.

In 2010 it was announced that U.S. President Barack Obama had ordered the extrajudicial killing of U.S. citizen Anwar al-Awlaki. The Islamic cleric resides in Yemen, but was born in New Mexico. The U.S. President issued the order, approved by the National Security Council, after it became evident that al-Awlaki was directly involved with the 2009 Fort Hood Massacre and with the 2009 Christmas Day bomb plot, the attempted destruction of a Detroit-bound passenger-plane. With this evidence, it was decided that al-Awlaki's normal legal rights as a citizen should be suspended and his death should be imposed, as he had effectively taken up arms against the United States and was a threat to its citizens.^[53]

True Bill

I woke up this morning with a slight feeling of negative anticipation but the day turned out to be very interesting and even what I tentatively might call fun in a learning experience kind of way.

I had been summoned to court for grand jury selection like I have had to do about every three years for more times than I can remember. Living in a small county and having a drivers license and a voting record makes it a fairly frequent occurrence.

But I had never had my name drawn out of the can until today when I won the grand jury lottery and got to walk to the jury box. Out of maybe 125 called for potential selection I was one of 2 guys and 10 ladies chosen by the random method of civic duty. My first thought was that maybe the luck of the draw is turning my way and that I should buy a powerball ticket.

The judge gave us the history of the grand jury dating back to at least the 12th century. Created for the protection of individuals from false accusations and oppressive governments. Instructions were given and we had the chance to try and opt out by declaring that we were of unsound mind or a habitual drunkard or drug abuser. Nope, not going there but for weeks I had thought of how I could honestly get dismissed if I wanted to when the judge asked if there's any other reason that might disqualify us from serving. I had always remembered the statement a Quaker man gave to the judge many years ago in a jury selection . He said:

"Your honor, my personal beliefs allow me to stand in judgement of my fellow man when they are accused of breaking the rule of law. But that duty also extends to my right and duty to also judge the law itself if I believe it is necessary. The concept of jury nullification of an unjust law must sometimes be taken into consideration."

In particular, a Lithuanian farmer and his wife came to the US to work on a corporate farm. It was understood they would learn, and be paid. They weren't paid, and ended up living as slaves. Loose Change (2005, 2006, 2007) is a series of documentary films written and directed by Dylan Avery, produced by Korey Rowe and Jason Bermas and distributed by Mercury Media International. The films assert that the September 11, 2001 attacks were planned and conducted by elements within the United States government, and base the claims on perceived anomalies in the historical record of the attacks. Below is the Fri. July 29 article by Paul Joseph Watson and Aaron Dykes exposing the larger program. Just as drug war border zones extending 50 miles on either side of the border are sold as "Constitution free zones" where rights can be violated, the ATF has effectively issued a freeze on gun dealers in 4 states, all while the Justice Department, ATF, FBI & Co. based in Phoenix ran a false flag under Operation Fast & Furious to arm drug gangs to frame sellers in the Southwest border zone. A similar false flag was run in Austin in 2010 where the ATF and local police staged an arrest and declared a ban on private sales in effort to shut down the Gun Shows, a favorite target of gun grabbers longing to close the "loopholes."

If Barack Obama, seeking to ban guns "under the radar," can get away with this bureaucratic tyranny through executive policy under his the Presidential agencies, then the executive branch can get away with anything. President Obama "the Constitutional scholar" has dangerously ruled by decree far too many times already: waging war with Libya while arrogantly saying he doesn't need to consult Congress; taxing carbon dioxide through the EPA when Congress wouldn't pass legislation; ignoring the Constitution by taking foreign titles under the U.N. and more. Exclusive: ATF Intimidates Gun Owners With Home Visits

Even as it finds itself embroiled in a scandal that saw weapons being deliberately sent to criminal gangs in Mexico, the ATF has issued a letter ordering firearms dealers in border states to report sales of two or more semi-automatic rifles, and is following it up by harassing gun owners with intimidating home visits as well as threatening gun dealers to spy on their customers.

As the Justice Department announced earlier this month, "All gun shops in four Southwest border states (Texas, California, Arizona and New Mexico) will be required to alert the federal government to frequent buyers of high-powered rifles."

The ATF letter also orders gun dealers to report to the feds sales of "two or more pistols or revolvers, or any combination of pistols or revolvers totaling two or more."

The letter, which was subsequently sent out to gun dealers and has since entered the public domain, orders firearms retailers to "Submit to ATF reports of multiple sales or other dispositions whenever, at one time or during any five consecutive business days, you sell to an unlicensed person or otherwise dispose of two or more semi-automatic rifles capable of accepting a detachable magazine and with a caliber greater than .22 (including .223/5.56 caliber)." The directive takes effect from August 14, 2011.

The federal government is enforcing a law that was never passed.

Obama Launches Gun Grab

Before 9-11, police were using tax dollars to pay informants, many who are criminals on probation and are parasites on humanity. These parasites are paid to ruin small business, set honest citizens up for being run through the courts system to support the lawyer/judge mafia. There is an education possible for newbies, those who have been banging their heads for years, or decades after being abused and ripped off in courts, may have new ambition to get together and to fight these tyrants.

Ct. General Statute 51-14 was passed in 1957 to limit the authority of the court to promulgate practice book rules which prohibited (shall not) abridge, enlarge or modify any substantive right or the jurisdiction of any of the courts."

Despite admonitions provided to the Rules Committee at the Supreme Court on May 31, and despite letters which have been delivered to the legislature which has the responsibility to follow the law including General Statute 51-14 protocols which require hearings to be conducted by the judiciary committee before such rules could be promulgated (adopted) for implementation.

Information obtained from the Office of Legislative research reported March 9, 2009, showed that a legislative fellow traced each and every practice book rule modification, and wrongly found that the Supreme Court self determined that the legislature had no authority over the Practice Book Rules modification approval process--He cited unspecific references to the Constitution of the State of Connecticut, which don't exist--which in fact, gave the legislature no authority to approve the rules of practice.

Documents which have been obtained under the Freedom of Information Act reveal that letters have been going from either the chair of the Rules Committee or the Chief Justice of the Supreme Court annually to the members of the judiciary committee in April of every year, showing clandestine meetings in the Supreme Court chambers, ie..non-public meeting with the Rules Committee and Supreme Court Justices, to review the proposed Rules of Practice.

According to this OLR document of 24 pages, tracing every single rules modification proposed since 1957, there has never been a single rule which has been rejected by the General Assembly by resolution--which is the proscribed proceedure outlined in Ct. General Statute 51-14 (b).

Such a lack of oversight of following the proper protocols by the legislature and its judiciary committee is a "wanton, willful and malicious" failure to uphold the laws to protect the citizens of the State of Connecticut from the self empowerment of the judiciary of the State of Connecticut which has resulted in a series of modifications since which have abridged the General Statute 51-14 prohibiting "judicial self empowerment" embodied in the words "the court shall have judicial discretion".

Prior to 1957, the Practice Book was a law. Since 1957, the egregious and absolute abuse of the acquisition of power by the jurists in the State of Connecticut, with the full complicity of the lawyers who sit on the public administrative committees of the judiciary, the full slate of judges in the State of Connecticut, the court administrators, the Governor, and the Attorney General's Office has participated in the unlawful abridgment of the Powers of Separation.

Further jurisdictional authority has been granted to the federal courts when a state does not enforce its own laws. Since virtually every member of the legislative judiciary committee was a lawyer by training, it is believed that in their private legal practices, the legislators received preferential decisions from judges who have made favorable rulings for the law firms where these legislators/lawyers are gainfully employed.

We know that the JRC has conducted only 11 public hearings over the years on judicial misconduct. The reason, we discover was in the word "should" in the old code was deemed by the JRC to not require (shall) that the judges take certain actions to acknowledge "conflicts of interests" which have abounded for years.

However, since a new Code of Judicial Conduct went into effect on January 1, 2011 which now requires ("shall") judges to hold proper disqualification hearings upon the filing of motions under Practice Book Rule 2.16 (e), the balance of power has shifted to allow for any of us to require an evidentiary hearing to allow a citizen to build a record for appeal of judicial bias and prejudice.

We can only continue to fight this "bare knuckles" battle of corruption in the family court system of our Constitutional and civil rights as parents to the love, care and companionship of our children as a fundamental liberty interest defined in the words "life, liberty and the pursuit of happiness."

Citizen Michael Nowacki is exposing how the Conn. Judicial Branch has been illegally engaging law-making practices:

On March 18, 2011, the Connecticut Ethics Commission undertook investigation into Chief Family Judge Lynda Munro's alleged unlawful solicitation for "sponsorship" from members of the Connecticut Bar Association for mandated family court directed training for Guardian Ad Litem G.A.L.s held at Quinnipiac University. They dismissed it.

Audience is asked to respond to mnowacki@aol.com as to whether Munro's solicitation of Bar funding for the GAL Program constitutes "making law from her secretive back chambers accountable by some state enforcement agency?

The FOIA Commission hesitates for having jurisdiction, saying Nowacki's contentions are not Administrative as defined by Conn. Supreme Court. (29:40 & 01:05:40) The hearing officer was referring to the 2006 decision, Clerk of GA 7 v. FOIC. That decision expanded the definition of "adjudicative" records to include simple docket sheet data which would become not subject to FOIA. The hearing officer attests @ 27:35 that he needs no coaching on the law by Mr. Nowacki because he's a professional 22 years on FOIA Law. Yet...

Clerk has nothing to do with the Nowacki case because Nowacki is not asking for anything to do with an individual case and privacy issues. He's asking for information on Public Hearings. The Law Tribune writes http://www.ctfog.org/CCFOI/subsite/LTValvoArticle.htm : "Three of the seven justices in Clerk favored test based on the 1988 case of Bar Examining Commission v. FOIC. Notes: Quinn: March 3, 2008: We do believe that administrative function should be defined as including the management of the internal institutional machinery of the court system, accounting, budgeting, personnel, facilities, physical operations, scheduling, record keeping, and docketing." That statement is answer to Officer Perpetua's J. Quinn question at 45:50.

In the 1983 case of Rules Committee v. FOIC, Chief Justice Ellen Ash Peters noted that the state FOI Act applies only to the Judicial Branch "administrative records" and not to "adjudicative records" that might interfere with the courts' critical function of deciding individual cases. Peters narrowly defined "administrative" matters as the "budget, personnel, facilities and physical operations of the courts." However, that was surpassed as shown above in 2008 by J. Quinn's notes which included all that encompasses internal institutional machinery, the point being Administrative acts as acknowledged by society are quite broad.

At the very least, it can be claimed Nowacki's failed FOIA to J. Munro and others about the GAL program and rule-making procedure was discovering the following: to know about records dealing with GAL budget or sponsorship, GAL personnel and even trainees, facilities at Quinnipiac and physical operations of the courts concerning the GAL. AMC "commando programs". After all, those Public Agency programs are physical operations that accommodate the efficient operations of the court, are administrative; and Nowacki is not seeking "adjudicative records" that might interfere with deciding any individual case.

Rules Committee v. FOIC is not so narrow that it limits the breadth of which administrative functions can still be carried out despite Clerk, thus is still under FOIA juris and oversight.

The hearing officer, Mr. Perpetua, @ 1:21:30 is dead wrong to have gone to such a narrow definition when "internal machinery" is the mantra, and when Nowacki points out the Superior Court and Appellate Court, and Chief Adm. J. Quinn acknowledges their rule-making falls as an administrative act @ 31:15 & 1:12:00. And when the Supreme Ct. NEVER limited Administrative tasks past docket and case sealing. Administrative function should be defined as including the management of the internal institutional machinery of the court system, which must include activity related to Rule-making. Why does Perpetua say different @ 1:21:15 ? Perpetua himself comes under scrutiny for then denying evidence relevance concerning Rule-making 1:15:45 . Judge Lynda B. Munro spearheaded a program aimed at influencing private law firms' hiring and employment practices. This is highly controversial behavior showing impropriety and warranting investigation of a conflict of interest, ethics, and even criminal allegations.

When a judge creates and manages, schedules,and coordinates a program like the GAL (Guardian Ad Litem) or AMC (Atty for the Minor Child) training sessions, a program under great social controversy whether or not it's actually destructive to families, promoted independently by this J. Munro, ... is that or is that not an Administrative function subject to FOIA Commission jurisdiction?

A series of disasters, potential disasters, bad news and worrying studies over the course of the past week have brought public attention back to the issue of radiation and its attendant health risks, and further exposed how governmental agencies that are supposed to protect the public have in fact knowingly put the public at risk and even colluded with the very industries they are supposed to be "regulating."

Welcome. This is James Corbett of The Corbett Report with your Sunday Update from the Centre for Research on Globalization at globalresearch.ca on this 3rd day of July, 2011. And now for the real news.

A series of disasters, potential disasters, bad news and worrying studies over the course of the past week have brought public attention back to the issue of radiation and its attendant health risks, and further exposed how governmental agencies that are supposed to protect the public have in fact knowingly put the public at risk and even colluded with the very industries they are supposed to be “regulating.”

Last Sunday, a wildfire started in New Mexico that grew to a 162 square mile inferno and came within 50 feet of the grounds of the Los Alamos National Laboratory that was the birthplace of the atomic bomb. The site is an historical testing ground for nuclear weapons and a storage area for about 20,000 barrels of nuclear waste. The disaster exposed the remarkable fact that this nuclear waste was stored not in a secure containment facility, or even in a solid building, but in a “fabric-type building” that would be quickly consumed by the fires.

In addition to the risk of the nuclear waste burning up in the fire and sending radioactive materials into the atmosphere, Joni Arends of the Concerned Citizens for Nuclear Safety has pointed out that the fire could stir up the nuclear-contaminated soil on lab property where nuclear experiments have long been conducted. In either event, harmful radiation could pass into the jet stream to be distributed across the United States and beyond.

As a recent report from the Alliance for Nuclear Accountability documented, the site has been the disposal ground for some 18 million cubic feet of radioactive and chemical solid wastes since 1943, as well as 899,000 curies of so-called transuranic waste, including plutonium. Liquid wastes from the plant were discharged into the canyons, initially with little treatment whatsoever.

Winds have now shifted the fire away from the facility and initial air samples from the inferno have indicated there has so far been no catastrophic release of radiation in the area, but it is unclear why no basic precautions were in place to secure the nuclear waste at the facility prior to the fire or what such measures, if any, are being contemplated in the wake of this emergency.

Also last Sunday, flood waters from the Missouri River reached the containment buildings of the Fort Calhoun Nuclear Station. A levee protecting the site’s electrical transformers gave way and the plant was forced to switch on emergency generators in order to continue cooling the nuclear reactor.

Although officials are maintaining that the plant is still functioning and is not in meltdown, the incident has raised serious questions about the facility and its preparedness for just such an event. Just last October, nuclear regulators warned that the Fort Calhoun plant “failed to maintain procedures for combating a significant flood” and newly released documents reveal workers were still scrambling to plug holes where flood water could potentially get into the facility as late as last week.

It is unclear what, if any, punitive actions the plant’s operator will face for their negligence, or if the Nuclear Regulatory Commission is even concerned. Commission director Gregory Jaczsko said last week that “all the plants in the U.S. have been been designed to deal with historically the largest possible floods,” seeming to imply that the Fort Calhoun situation was not dangerous by definition and that the NRC had full faith in the plant despite its documented safety violations.

This is in line with an AP investigation last month that found that American federal nuclear regulators have been working with the nuclear industry to ensure that reactors passed safety inspections by repeatedly lowering safety standards for the plants or failing to enforce existing standards. The investigation showed that a myriad of documented problems at nuclear power plants across the country, from failed cables and busted seals to broken nozzles, dented containers and rusty pipes, were routinely resolved by claiming that existing safety standards were too conservative. When valves were found to be leaking, for instance, the standards were simply changed to allow for more leakage, in some cases 20 times the original limit.

Meanwhile in Japan, where three of the reactors at the troubled Fukushima Daiichi nuclear plant have been confirmed to have been in full meltdown since the very first days of the tsunami-induced disaster, the first series of health checks of area residents are already revealing suprising and troubling results about radiation exposure in the area. Tests of 15 Fukushima residents between the ages of 4 and 77 have revealed radioactive cesium and iodine in their urine.

The tests also indicate that residents have been exposed to between 1 / 5 to 3 / 4 of their yearly allowable radiation dose in just two months.

Now, documents are beginning to surface confirming what many have been alleging since the start of this crisis: that governments the world over have been conspiring with the nuclear energy industry to downplay the significance and ramifications of the Fukushima disaster.

Just last week, emails released under the Freedom of Inforrmation Act show how the Departments of Business and Energy in the UK government were coordinating their response to the Japanese disaster with companies like EDF Energy, Areva and Westinghouse to ensure the accident did not interfere with plans to build a new generation of nuclear power plants in Britain.

The emails reveal how the Department of Business, Innovation and Skills was emailing the nuclear firms on the 13th of March, as the crisis was still unfolding, to assure them that “radiation released has been controlled – the reactor has been protected,” a surprisingly definitive description of the events at Fukushima that have now been shown to have been categorically wrong, as reactor 1 had in fact melted down in the first 16 hours of the disaster, with 2 and 3 also melting down in the following days.

They also show how the BIS intimated that comments from the nuclear industry would be worked into the departments briefs to ministers and government statements: “We need to all be working from the same material to get the message through to the media and the public.”

In other radiation-related news, an entirely different set of emails among government officials obtained under the Freedom of Information Act last week reveal that the National Institute of Standards and Technology, the very same organization that has refused to release the data that its model for the collapse of World Trade Center 7 was based on because it would “jeopardize public safety,” has accused the Department of Homeland Security of lying about its findings on the safety of the full body scanners being used in airport screening by the TSA.

The email reveals how NIST rebuked DHS head Janet Napolitano for claiming in a USA Today op-ed that:

“AIT machines are safe, efficient, and protect passenger privacy. They have been independently evaluated by the Food and Drug Administration, the National Institute of Standards and Technology and the Johns Hopkins University Applied Physics Laboratory, who have all affirmed their safety.”

According to the email, however, NIST was angry at this mischaracterization of their work, pointing out that “NIST does not do product testing. [And] NIST did not test AIT machines for safety.”

As it turns out, not only did Napolitano lie about NIST’s certification of the scanner safety, but she also lied about the Johns Hopkins backing of her position. An internal document produced by Johns Hopkins for the DHS shows that far from “affirming the safety” of the technology, the University in fact warned that the scanners as designed produces an area around the machine that exceeds the general public dose limit for radiation exposure.

Napolitano’s op-ed was widely criticized at the time because Dr. Michael Love, the head of an X-ray lab at Johns Hopkins warned just two days before the op-ed was published that “statistically someone is going to get skin cancer from these X-rays.”

On average 70% of wealth is lost in divorce. That is criminal and is proof lawyers have control of government for themselves and for corporations. This robbery alone is helping crash the economy.

A Brattleboro Vermont used car salesman who sexually assaults and harasses male employees also rips customers off along with his salespeople. I sued him in small claims. His claim to fame is being a cocaine dealer with links to organized crime, saying he owns the courts and police. I sued him, judges waited to the last minute to recuse themselves, I had to serve him 3 times for the same case, and it took 3 months to get an answer that nothing was to be awarded. Courts are a scam. No wonder Obama on down have no fear of breaking laws.

If Congress and the Senate can't act for the will of the people, having no ground wars in Libya and other countries, for illegal corporate banking cartel occupation, why should that puppet show continue?

Los Angeles, June 20 – Joseph Zernik, PhD, and Human Rights Alert (NGO) filed complaint with the US Congress and with the US Attorney Office, Los Angeles, against US Judge JOHN WALTER, US Magistrate CARLA WOEHRLE, Clerk of the Court TERRY NAFISI, and others in the US District Court, Central District of California, alleging public corruption through the conduct of simulated litigation [[i]] in Richard I Fine v State Bar of California et al (2:10-cv-00048). [[ii]]
Dr Zernik has gained substantial experience in analyzing fraud in state and US court records in recent years. His opinions were repeatedly supported by highly reputed experts. [[iii]]
Richard I Fine v State Bar of California et al originated in Fine’s complaint pursuant to Deprivation of Rights under the Color of Law (42 US §1983), alleging the circumstances, where California Judges illegally conspired against him at the behest of the State Bar officials, Los Angeles County government officials, and lawyers for the developers, who opposed him in the courtroom. However, the affair as a whole should be deemed part of the intimidation, harassment, and retaliation against the former US prosecutor Richard Fine. Following his protest of the corruption of California judges, he was held in solitary confinement for 18 months, starting March 2009, with no warrant ever issued, and no judgment/conviction or sentencing ever entered in his case. Eventually, he was released with no valid court order, either. [[v]]
The complaint further alleged that the case reflects conduct of a racketeering enterprise, the LA-JR (alleged Los Angeles Judiciary Racket), which undermines the rights of all 10 millions, who reside in Los Angeles County, in particular, and residents of California, in general. Conduct of the Los Angeles courts in both the civil and criminal divisions was the core evidence, submitted by Dr Zernik to the United Nations, which the 2010 Human Rights Council report, which noted, “corruption of the courts and the legal profession and discrimination by law enforcement in California”. The complaint also provides further evidence of the large-scale fraud in the design and operation of the public access and case management systems of the US courts, PACER and CM/ECF, [[viii]] and patronizing of the LA-JR by certain US judges in the US District Court, Central District of California. A pattern of false and deliberately misleading court records is found in the case of Richard I Fine v State Bar of California et al (2:10-cv-00048):

Clerk of the Court TERRY NAFISI refuses to certify any of the PACER dockets of the court;

No valid summonses are found in the docket, in alleged violation of Duties of the Clerk pursuant to the Federal Rules of Civil Procedure;

No Civil Cover Sheet is found in the docket, which is required for the opening of a civil docket;

No valid Assignment Order for Judge JOHN WALTER is found in the docket;

No valid Referral Order for Magistrate CARLA WOEHRLE is found in the docket;

Numerous entries in the docket are by Ms DONNA THOMAS, who upon information and belief is not a Deputy Clerk, and Clerk of the Court TERRY NAFISI has denied numerous requests to confirm or deny DONNA THOMAS’s authority as a Deputy Clerk;

The Clerk of the Court routinely denies access to the electronic authentication records (NEFs – Notices of Electronic Filing), and in similar cases, where the same persons were accused, all NEFs were eventually discovered to be invalid;

Attorney KEVIN MCCORMICK, who appears in this case on behalf of the Defendants, falsely appeared on behalf of related defendants in a related case, with no authority at all, and

No declaration or any other record signed by any of the Defendants is found in the pleading filed on their behalf, consistent with conduct of simulated litigation, and appearance by an unauthorized attorney.

The case should be deemed of the highest public policy significance, since it holds at bay the prospect of any honest court services in Los Angeles County, in particular, and in California, in general. Of note, the 2010 official Staff Report of the Human Rights Council of the United Nations referred to "corruption of the courts and the legal profession and discrimination by law enforcement in California".

The case also reflects the fraud inherent in the design and operation of PACER and CM/ECF, the public access and case management systems of the US courts.
The complaint was copied to the US Congress Judiciary Committees and the Human Rights Council of the United Nations.

Private Prisons and the American Police State

In the last few decades, the population of our National Prisons has nearly tripled. This phenomenon can be attributed to many factors ranging from the increasing economic insecurity to the War on Drugs. Statistics tell us that 1 in 18 American men are now incarcerated or being monitored. Although this number could be reasonably justified as a reflection of our social morality breakdown, America still leads the world in per capita imprisonment and the privatization of the our corrections system calls into question the motives behind tougher sentencing and the ever increasing police state in this country.

Since 1980, the increase of population in prisons or under surveillance by the judicial system has increased to over 7 million persons. This increase is said to be attributable to the following factors:

Increased federalization of crime - The federal government has expanded its control into areas that have historically fallen under state jurisdiction.

Mandatory sentencing policy - Mandatory minimum sentencing policies adopted by Congress beginning in 1984 have contributed substantially to the number of drug offenders in federal prison, both by removing discretion from sentencing judges and increasing the length of sentence for many offenders.

Federal sentencing guidelines - An examination of sentencing changes in the first years of the guidelines' implementation found that the proportion of offenders sentenced to prison rose from 52% in pre-guideline cases in 1986 to 74% in guideline cases by 1990.

What is interesting is how the population increase per year has leveled off to"only" a 51% increase annually. Some will use this statistic to congratulate the growing police state and mandatory sentencing structure but the real reason is a profound lack of new prisons to house the inmates. Couple this with the recent California Supreme Court Case ruling on prison overcrowding and the need for more prisons and their associative costs becomes a dilemma needing to be addressed.

As Dana Joel explains:

"As a national average, it costs roughly $20,000 per year to keep an inmate in prison. There are approximately 650,000 inmates in state and local prisons, double the number five years ago. This costs taxpayers an estimated $18 billion each year. More than two thirds of the states are facing serious overcrowding problems, and many are operating at least 50 percent over capacity."

As evidence of this overcrowding problem; the California Supreme Court recently ruled that overcrowding was unconstitutional because it results in "cruel and unusual punishment," a violation of the US Constitution's Eighth Amendment. This translates to mean either the prisons release a portion of its population or it must finds ways to maintain the present prison nation many of our citizens exist in.

In her article, Joel goes on to explain what she believes is the impetus for the drastic increase in prison populations:

Destruction of the Family & Marriage . The destruction or non-formation of the two-parent family is heavily correlated with increased levels of juvenile delinquency and crime.

Illegal Drugs & the War on Drugs . New illegal drugs or new forms of those drugs were discovered and developed. A War on Drugs swelled the prison population. Unlike real war combatants who destroy or disable their enemies, the government only puts the enemy in cages temporarily, and then releases drug war POWs to fight another day.

Abolition of Parole in the Federal System . The Sentencing Reform Act of 1984 abolished parole in the federal system, sought to eliminate huge sentencing disparities, basically made all federal sentences determinate, rejected "imprisonment as a means of promoting rehabilitation," and said "punishment should serve retributive, educational, deterrent, and incapacitative goals."

Mandatory Minimum Sentences . The federal government and states enacted various mandatory minimum sentence laws, requiring judges to impose minimum sentences for designated crimes, including drug crimes.

Three-Strikes Habitual Offender Laws . Three-strikes habitual offender laws in many states mandated life sentences after the third felony conviction.

Incarceration of the Mentally Ill . As mental hospitals de-institutionalized and drastically reduced the number of their patients, the mentally ill increasingly wound up in prison. Mentally ill people in large numbers changed from institutionalization in state mental hospitals to incarceration in state prisons. Around 16% of the current American prison population is mentally ill.

On the last factor: The current push by Congressional members at both the Federal and State level to defund social programs dealing with mental health care creates an even grater need for not only prison beds but more established medical care facilities within them. More and more institutions under the control of the Department of Corrections are being opened to replace this standard, social model. Instead of help, the mentally ill receive jail time. In a society where the new normal has become self-indulgence over the care of one's Earth bound brothers and sisters, this makes perfect sense but in the real world, it is a travesty of epic proportion.

As a population becomes more and more dense, the struggles to survive become greater and aggression increases within the social strata. This correlation creates a situation where crime rates increase dramatically, prompting the police force to increase proportionately. The result of the ensuing insanity is a judicial system which becomes overburdened with criminal case loads and by proxy, more people are sent to prison or into the controlling probation system.

This is the current, standard model of the crime/population ratio but today, we are facing less than standard conditions, leading to an even greater problem within the judicial system. Not only is the human rights issue and the legal enslavement of people at the forefront, the financial burden on Federal government becomes enormous.

To compensate for the decrease of federal dollars going to the care of prisoners and to sate the requirements for more space by a growing police state, the Department of Corrections began to look elsewhere for financing of in its endeavors to continue the incarceration of so many of our people.

It would of course, make too much sense for our government to reform sentencing and fix our broken judicial system. In lieu of otherwise, reasonable solutions, the D.O.C., operating within the insanity of our corrupt political system, has opened up the market to for-profit based companies to invest in it.

Joel explains this relationship:

"An example (of corporate run prisons) is General Electric Government Services, a subsidiary of General Electric Company, which took over RCA Service Company two years ago. General Electric Government Services now runs the Weaversville Intensive Treatment Unit, a juvenile institution in Pennsylvania established by RCA Service Company in 1975.

Responding to Pennsylvania's urgent request for a high-security juvenile facility, RCA converted an empty state-owned building into a correction center in just ten days and positioned its staff to run the operation. In addition to the Weaversville Center, General Electric Government Services runs the Evaluation and Treatment Center in Rhode Island and the Bensalem Youth Development Center in Pennsylvania. Another significant development is the growth of joint venture agreements between local firms and national corporations."

So now, not only is General Electric one of the largest weapons manufacturer s in the U.S. and seemingly tax exempt from Federal rolls, they are now investing heavily in the private prison industry. (One cannot help but see the philosophical parallel to the imprisonment of our Nation in our current prison of National debt and the decreasing personal, financial security as its corporate controllers attack education and worker representation.)

U.S. Corrections Corporation, a private company headquartered in Louisville to date, runs over 60 prisons in about 20 U.S. states plus Washington, DC. CCA has contracts with federal, state, and local governments to run the prisons. The company owns most of the facilities and provides rehabilitation services for inmates. Begun in 1983, it is the largest prison corporation in the U.S. Only the federal government and three states have larger prison systems. The company trades on the New York Stock Exchange with the symbol CXW. In 2006, revenue was $1.3 billion with profits of $105 million.

With numbers like these, it is no mystery why the soulless machine of Capitalism would attach itself to this new form of human usury. How many people have to be imprisoned to satisfy this insatiable machine? In this age of degrading social morals and political ethics, one would easily be led to believe this form of prisoner slavery is a new one but it is not. In 1893, Fredrick Douglas wrote of this system being in place and using the black culture as the largest contributor to it.

Today, the system has not changed much. Still, the ratio of black inmates to the rest of the prison population is imbalanced and prisoners are still working for the man. One could justifiably argue that it teaches work ethic, responsibility and serves as payment on their debt to society but when this debt payment becomes the profit of the corporate interest; the means do not justify the ends especially considering how many "free men" are out of work right now.

To this author, the symbolic poignancy of this reality confirms the growing opinion that the corporatists want the American worker to be as slave labor by way of China's efficient model. In the same way that NAFTA effectively lowered farm worker's pay scale in America and Mexico, this new prison labor system is allowing jobs normally held by freemen to be given to this growing, slave labor market.

With the abolition of Union representation and the ongoing "attraction" of business into individual States, the issue of labor costs and tax breaks working in concert, have come to the forefront in the political game of American industry reclamation. With prisons providing workers and States, tax breaks through defunding social programs, even our private lives have become prisons of their own. The jailers have taken the form of CEOs and Governor's paid for by them. The main difference though, is this prison often does not provide "three hots and a cot".

Instead of reducing Federal and State sentencing mandates and increasing funding to help our citizens cope with an increasingly stressful social environment through outreach programs, those who are supposed to be representing and protecting our freedoms have made concessions to corporations in order to increase the number of prisons in our country and their associated free labor pool.

Does this remind anyone of any time in the History of our Nation when labor was used to the benefit of the Landowners and not the labor force? If it doesn't, you may want to pick up a history book and read about pre-Civil War days when decades of slavery created a great deal of wealth for a few while imprisoning an entire people. Maybe then you will realize the damaging course this nation has embarked upon. They say history is cyclical and no where is this more horrifying than in our present Incarceration Nation.

In Cedar Falls, Iowa, the government is attempting to nullify the Fourth Amendment. The City Council is scheduled to vote on the third and final reading of an ordinance adopting a 2009 International Fire Code that specifies the fire chief can require lock boxes for emergency access to keys to buildings.

According to the WCF Courier, the Cedar Falls ordinance would require lock boxes be installed on commercial buildings and apartment buildings with three or more separate units. Since 2004 the city has required the boxes for commercial buildings with alarm systems and apartment buildings with six or more units.

Prosecution Against Drake Collapses; Drake Pleads to Minor Charge

The Justice Department's case against National Security Agency (NSA) whistleblower Tom Drake was a case built on sand that collapsed under the weight of the truth.

Bravo Tom Drake, for refusing to compromise on the truth, standing firm for our Constitution, and responding to government's outrageous allegations with poise and honesty.

The Justice Department sought to put Drake in jail for 35 years and accused him of violating the Espionage Act. Instead, Drake will plead this morning (just days before he was to begin trial) to a minor misdemeanor, exceeding authorized use of a government computer, with the government agreeing to no jail time and no fine. This is an unambiguous victory for Drake , who has endured the most severe from of whistleblower retaliation I have ever seen. The Justice Department's decision to prosecute Drake was pure retribution for his blowing the whistle on massive NSA waste and illegality, and the government's glaring defeat is a victory for whistleblowers who refuse to let government agencies hide wrongdoing behind secrecy and threats of retaliation.

The experts weighed in on the plea deal :

"It's a pale shadow of the original indictment," said Steven Aftergood of the Federation of American Scientists, who works on government secrecy issues and has been following the Drake case. "The defendant was facing decades in prison, and all of the sudden the government says never mind. It's a pretty big reversal of course."

The case against Drake imploded this week in the face of numerous negative rulings from Judge Richard Bennett and growing, widespread public support for Drake. ( The New Yorker and 60 Minutes reported on the case in May, and last week the The Washington Post's conservative editorial board opined that the Drake prosecution "smacks of overkill.")

The plea deal is consistent with what Tom Drake told the government all through his years-long ordeal - the truth - that he never disclosed classified information to a reporter. Drake turned down earlier plea deals because he did not want to plea bargain with the truth.

The Drake case is part the Obama administration's twisted strategy to bastardize the Espionage Act to go after public servants who blow the whistle on government wrongdoing. The Espionage Act prosecutions are meant to send a chilling message to whistleblowers. Scott Shane of the New York Times writes :

The case against Mr. Drake is among five such prosecutions for disclosures to the news media brought since President Obama took office in 2009: one each against defendants from the National Security Agency, the C.I.A., the F.B.I., the military and the State Department. In the past, such prosecutions have been extremely rare -- three or four in history, depending on how they are counted, and never more than one under any other president.

The Justice Department's defeat in the Drake case only emphasizes the point scholars and transparency advocates have been making all along: the Espionage Act is an archaic law meant to go after spies, and it should not be used to go after whistleblowers.

The experts agree, Ellen Nakashima of WaPo quotes law professor Stephen Vladeck, who points out that using the Espionage Act is even more nefarious considering that massive over-classification plagues the intelligence community:

"As a tool for prosecuting leakers, the Espionage Act is a broad sword where a scalpel would be far preferable," said Stephen Vladeck, a constitutional law professor at American University. "It criminalizes to the same degree the wrongful retention of information that probably should never have been classified in the first place and the willful sale of state secrets to foreign intelligence agencies."

The New Yorker's Jane Mayer reports :

The prosecution has been seen as a test of the government's use of the Espionage Act to crack down on alleged leakers of national-security secrets. The withdrawal of all felony charges, and acceptance of no jail time for Drake, will likely be seen as evidence that the government overreached in using the Espionage Act against news sources rather than spies.

Drake's victory is a blow to the Obama Administration's attempts to create an Official Secrets Act without congressional approval by criminally prosecution whistleblower under the Espionage Act. The message to the Obama administration is clear: criminalizing whistleblowing does not work with the public or in our federal courts.

Despite Lanny Breuer's inflammatory opening press statement when the Drake indictment came down over a year ago that

Our national security demands that the sort of conduct alleged here-- violating the government's trust by illegally retaining and disclosing classified information-- be prosecuted and prosecuted vigorously.

the Justice Department, as per usual with the widespread media reports critical of the Drake prosecution, declined comment on the plea deal.

The War Powers Resolution of 1973 (50 U.S.C. 1541-1548)^[1] is a federal law intended to check the power of the President in committing the United States to an armed conflict without the consent of Congress. The resolution was adopted in the form of a United States Congress joint resolution; this provides that the President can send U.S. armed forces into action abroad only by authorization of Congress or in case of "a national emergency created by attack upon the United States, its territories or possessions, or its armed forces."

The War Powers Resolution requires the President to notify Congress within 48 hours of committing armed forces to military action and forbids armed forces from remaining for more than 60 days, with a further 30 day withdrawal period, without an authorization of the use of military force or a declaration of war. The resolution was passed by two-thirds of Congress, overriding a presidential veto.

Despite the apparent non-ambiguity of its language, the War Powers Resolution has been regularly ignored by presidents of both parties,^[2]^[3]some even declaring their belief that the act is unconstitutional.^[4]^[5]

The International Monetary Fund's director, Dominique Strauss-Kahn, was arrested last Sunday in New York City on the allegation of an immigrant hotel maid that he attempted to rape her in his hotel room. A New York judge has denied Strauss-Kahn bail on the grounds that he might flee to France.

President Bill Clinton survived his sexual escapades, because he was a servant to the system, not a threat. But Strauss-Kahn, like former New York Governor Eliot Spitzer, was a threat to the system, and, like Eliot Spitzer, Strass-Kahn has been deleted from the power ranks.

Strauss-Kahn was the first IMF director in my lifetime, if memory serves, who disavowed the traditional IMF policy of imposing on the poor and ordinary people the cost of bailing out Wall Street and the Western banks. Strauss-Kahn said that regulation had to be reimposed on the greed-driven, fraud-prone financial sector, which, unregulated, destroyed the lives of ordinary people. Strauss-Kahn listened to Nobel economist Joseph Stiglitz, one of a handful of economists who has a social conscience.

Perhaps the most dangerous black mark in Strauss-Kahn's book is that he was far ahead of America's French puppet, President Sarkozy, in the upcoming French elections. Strauss-Kahn simply had to be eliminated.

It is possible that Strauss-Kahn eliminated himself and saved Washington the trouble. However, as a well-travelled person who has often stayed in New York hotels and in hotels in cities around the world, I have never experienced a maid entering unannounced into my room, much less when I was in the shower.

In the spun story, Strauss-Kahn is portrayed as so deprived of sex that he attempted to rape a hotel maid. Anyone who ever served on the staff of a powerful public figure knows that this is unlikely. On a senator's staff on which I served, there were two aides whose job was to make certain that no woman, with the exception of his wife, was ever alone with the senator. This was done to protect the senator both from female power groupies, who lust after celebrities and powerful men, and from women sent by a rival on missions to compromise an opponent. A powerful man such as Strauss-Kahn would not have been starved for women, and as a multi-millionaire he could certainly afford to make his own discreet arrangements.

As Henry Kissinger said, "power is the ultimate aphrodisiac." In politics, sex is handed out as favors and payoffs, and it is used as a honey trap. Some Americans will remember that Senator Packwood's long career (1969-1995) was destroyed by a female lobbyist, suspected, according to rumors, of sexual conquests of Senators, who charged that Packwood propositioned her in his office. Perhaps what inspired the charge was that Packwood was in the way of her employer's legislative agenda.

Even those who exercise care can be framed by allegations of an event to which there are no witnesses. On May 16 the British Daily Mail reported that prior to Strauss-Kahn's fateful departure for New York, the French newspaper, Liberation, published comments he made while discussing his plans to challenge Sarkozy for the presidency of France. Strauss-Kahn said that as he was the clear favorite to beat Sarkozy, he would be subjected to a smear campaign by Sarkozy and his interior minister, Glaude Gueant. The Daily Mail reports that Strauss-Kahn's suspicions are supported by the fact that the first person to break the news of Strauss-Kahn's arrest was an activist in Mr Sarkozy's UMP party -- who apparently knew about the scandal before it happened. Jonathan Pinet, a politics student, tweeted the news just before the New York Police Department made it public, although he said that he simply had a 'friend' working at the Sofitel where the attack was said to have happened. The first person to re-tweet Mr Pinet was Arnaud Dassier, a spin doctor who had previously publicised details of multi-millionaire Strauss-Kahn's luxurious lifestyle in a bid to dent his left wing credentials.

Strauss-Kahn could just as easily been set up by rivals inside the IMF, as well as by rivals within the French political establishment.

Michelle Sabban, a senior councillor for the greater Paris region and a Strauss-Kahn loyalist said: 'I am convinced it is an international conspiracy.'

She added: 'It's the IMF they wanted to decapitate, not so much the Socialist primary candidate.

'It's not like him. Everyone knows that his weakness is seduction, women. That's how they got him.'

I was in parts of the former Soviet Union, not Russia, soon after the wall fell. I heard about organized crime, police, the government, and women who the White Male Police Officers thought were hot, could then be raped by all the police officers in the station, when a woman tried to report being raped. We aren't far away from those scenarios here in the US as policing and the courts have degraded beyond imagination.

The drug cartels, violence, and US military and CIA abuse of the world is a result of the lack of representation for US taxation and because the voting system is rigged.

Resistance is Futile

In the law, there have been certain very specific places which no court, no judge, is bold enough to breech. The front door of a person's home, his castle, was one such place. No more.

The Indiana Supreme Court, in a 3-2 decision, has taken the state of law since the King John's signing of the Magna Carta in 1215 and decide that it no longer serves our "modern" world. In Barnes v. State, the court held that the sanctity of our homes is a thing of the past.

We believe . . . that a right to resist an unlawful police entry into a home is against public policy and is incompatible with modern Fourth Amendment jurisprudence. Nowadays, an aggrieved arrestee has means unavailable at common law for redress against unlawful police action. E.g., Warner, supra, at 330 (citing the dangers of arrest at common law—indefinite detention, lack of bail, disease-infested prisons, physical torture—as reasons for recognizing the right to resist); State v. Hobson, 577 N.W.2d 825, 835–36 (Wis. 1998) (citing the following modern developments: (1) bail, (2) prompt arraignment and determination of probable cause, (3) the exclusionary rule, (4) police department internal review and disciplinary procedure, and (5) civil remedies). We also find that allowing resistance unnecessarily escalates the level of violence and therefore the risk of injuries to all parties involved without preventing the arrest— as evident by the facts of this instant case. E.g., Hobson, 577 N.W.2d at 836 (“But in arrest situations that are often ripe for rapid escalation, one‘s 'measured‘ response may fast become excessive.”).

The case involved a domestic dispute, where the defendant was confronted by police outside his home. There was no basis to arrest him, any more than there is a basis to arrest a man any time he and his wife have an argument, and so the defendant went inside. He refused the police entry, and when they forced their way in, pushed an officer up against a wall. For that, he was charged with misdemeanor battery.

In defense to the charge, the defendant relied on his right to resist an illegal entry into his home, whether by police or anyone else. But the the entry was by police, officers of the state, made it of particular significance. This was the core evil against which the Fourth Amendment protects. Note the use of the past tense.

But this has now been declared archaic, a relic of a past age, of which modern man, and courts, no longer have need. The court says we have other, better, options than to resist: the exclusionary rule, internal police department review and disciplinary procedures and civil remedies. Perhaps this is a penumbra of the "new professionalism" we've heard so much about, and have yet to enjoy for ourselves.

The gist of the court's ruling, however, is that they're doing this for us, for the children, to safeguard us from violence. Resisting the police escalates violence, and enhances the likelihood that someone will be hurt. They just don't want us to get hurt, and if the front door to our homes is the cost of our safety, then so be it. As the court tangentially notes, it's not like law prohibiting police entry actually stops the police from doing as they please, so better to eliminate the law than mandate police adherence.

There is no line more fundamental than that running across our threshold. Courts have been trying to erase if for a long time, bit by bit. The Indiana Supreme Court seizes upon these "exceptions" to conclude that the fundamental rule has been eroding for so long as to make this final step, the erasure of the rule altogether, merely the obvious last slide down the slope.

Further, we note that a warrant is not necessary for every entry into a home. For example, officers may enter the home if they are in “hot pursuit” of the arrestee or if exigent circumstances justified the entry. E.g., United States v. Santana, 427 U.S. 38, 42–43 (1976) (holding that retreat into a defendant‘s house could not thwart an otherwise proper arrest made in the course of a ?hot pursuit?); Holder v. State, 847 N.E.2d 930, 938 (Ind. 2006) (“Possible imminent destruction of evidence is one exigent circumstance that may justify a warrantless entry into a home if the fear on the part of the police that the evidence was immediately about to be destroyed is objectively reasonable.”). Even with a warrant, officers may have acted in good faith in entering a home, only to find later that their entry was in error. E.g., Arizona v. Evans, 514 U.S. 1, 11 (1994); United States v. Leon, 468 U.S. 897, 922–25 (1984). In these situations, we find it unwise to allow a homeowner to adjudge the legality of police conduct in the heat of the moment.

While it's easy to argue slippery slope in opposition to the creation of any particular exception to a rule, that doesn't mean it isn't accurate and doesn't happen. This is the proof.

The dissent, by definition, disagrees.

[T]he common law rule supporting a citizen‘s right to resist unlawful entry into her home rests on . . . the Fourth Amendment to the United States Constitution. Indeed, “the physical entry of the home is the chief evil against which the wording of the Fourth Amendment is directed.” Payton v. New York, 445 U.S. 573, 585 (1980). In my view it is breathtaking that the majority deems it appropriate or even necessary to erode this constitutional protection based on a rationale addressing much different policy considerations. There is simply no reason to abrogate the common law right of a citizen to resist the unlawful police entry into his or her home.

In Miller v. United States, 357 U.S. 301, 313–14 (1958) the United States Supreme Court held that it was unlawful to arrest the defendant on criminal charges when a warrantless arrest was conducted by police officers breaking and entering the defendant‘s apartment without expressly announcing the purpose of their presence or demanding admission. In recounting the historical perspective for its holding the Court quoted eighteenth century remarks attributed to William Pitt, Earl of Chatham, on the occasion of a debate in Parliament:

The poorest man may in his cottage bid defiance to all the forces of the Crown. It may be frail; its roof may shake; the wind may blow through it; the storm may enter; the rain may enter; but the King of England cannot enter – all his force dares not cross the threshold of the ruined tenement!

Id. at 307. The same is no less true today and applies equally to forces of the State.

Defiance will no longer be tolerated in Indiana, for our own safety and because we didn't challenge the small slides down the hill along the way. Now that we're at the bottom, should we be surprised?

Divorced Wilton (Connecticut) father struggling to change system

Divorce is never an easy process, especially when children are involved, and Wilton resident Francis Knize says being a father makes it exponentially more difficult.

Knize went through a nasty divorce a few years ago, and, based on his own experience, he feels judges in divorce cases "have an inherent bias against men."
"Basically the judiciary has worked hard to erode (father's) civil rights on many levels. In my divorce case my person, property and papers were what I wanted protected, and they were all broken in the divorce. There was nothing I could make a free choice of in my life."

Knize said the immediate reaction of the courts is to place children with the mother in the vast majority of divorce cases.

"Basically the child remains with the mother right away until further notice, and the father may not see the child for the first year after the divorce," Knize said. "That's unconscionable."

One of the basic problems, according to Knize, is that divorce cases are tried in civil court, where the burden of proof is far different than that of a criminal proceeding.

"I know lots of men who have serious problems seeing their children because women take the stand claiming severe abuse," Knize said. "They make a criminal kind of charge, without having to support it with any kind of evidence. In a civil court the burden is a preponderance of evidence, and conclusions come much more easily. Women are making claims without corroborating evidence or proof."

Given certain allegations, such as abuse or neglect, divorce cases in Connecticut should require concrete evidence to back up the claim, he said.

"Why can't Connecticut be more like New Jersey, where you need clear and convincing evidence, if not evidence beyond a reasonable doubt, like a criminal case?"

To that end state Rep. John Hetherington, R-125, has introduced House Bill 5247 to try and close some of those civil rights loopholes for parents and guardians.

HB 5247, which Hetherington said has passed the Judiciary Committee and now awaits discussion in the General Assembly, is described as "an act concerning the presumption of innocence and protection of Constitutional rights in proceedings alleging child abuse or neglect by a parent or guardian."

The body of HB 5247 reads: "Be it enacted by the Senate and House of Representatives in General Assembly convened:

That the general statutes be amended to: (1) institute a presumption of a parent's or guardian's innocence in any proceeding alleging child abuse or neglect by the parent or guardian; (2) require the petitioner to prove a parent's or guardian's guilt beyond a reasonable doubt in any proceeding alleging child abuse or neglect by the parent or guardian; (3) require the protection of a parent's or guardian's constitutional rights, as afforded to persons charged with criminal offenses, in any proceeding alleging child abuse or neglect by the parent or guardian; (4) require the dismissal from employment of any municipal or state employee found to have violated the constitutional rights of a parent or guardian in any proceeding alleging child abuse or neglect by the parent or guardian; and (5) ensure that any such municipal or state employee not receive immunity."

Hetherington said this is a "relatively simple" bill that will not apply directly to court proceedings but could prevent a parent or guardian from self-incrimination, or keep them from allowing a Department of Children and Families (DCF) representative into their home without cause.

"I heard a number of complaints from parents and guardians in cases of child neglect or abuse that DCF representatives are rather heavy handed," Hetherington said. "Now the DCF has the right to interrogate, to insist on coming into the home to find evidence of abuse, and what they collect is admissible in proceedings or as evidence to take a child away."

Hetherington admits that the bill does not have much sanction behind it, but it provides some peace of mind to parents and guardians.

"Parents and guardians have rights, and (DCF) can't intimidate people," Hetherington said. "There's no doubt DCF people are good, but they can't make people suspects without some evidence."

Hetherington is not sure how far -- or how fast -- the bill will move.

"It's received a joint favorable report out of Judiciary, and I hope it goes to House floor," he said. "There's such a crowd of bills, you never know."

Knize never intended his efforts to be a mother-father battle. He just wants to see each case, and each parent, judged on their own merits.

"What's the percentage of men that have to pay child support over women? Over 90 percent," Knize said. "My argument is that maybe that should have been the case in the 1950s, when there were different gender roles. In today's world, after women demanded freedom and are working, the payment structure should be more equalized."

Knize said his ex-wife had college degrees and plenty of earning potential and he did not, and while he was self-sufficient, he still was taken for $1 million.

"You're liable for child support and possibly alimony because you have earning capacity, but my wife had enormous earning capacity," Knize said. "A judge can assign an unreachable child support level, and a father who can't pay is in contempt. They're handcuffed, they have their ankles shackled. They throw you in jail until you pay up, like an old English debtor's prison. We're supposed to be above that. We want it to be equal parenting." Connecticut Court Corruption- The Nowacki FOIA Case 4.11.11

Citizen Michael Nowacki is exposing how the Conn. Judicial Branch has been illegally engaging law-making practices:

On March 18, 2011, the Connecticut Ethics Commission undertook investigation into Chief Family Judge Lynda Munro's alleged unlawful solicitation for "sponsorship" from members of the Connecticut Bar Association for mandated family court directed training for Guardian Ad Litem G.A.L.s held at Quinnipiac University. They dismissed it.

Audience is asked to respond to mnowacki@aol.com as to whether Munro's solicitation of Bar funding for the GAL Program constitutes "making law from her secretive back chambers accountable by some state enforcement agency?

The FOIA Commission hesitates for having jurisdiction, saying Nowacki's contentions are not Administrative as defined by Conn. Supreme Court. (29:40 & 01:05:40) The hearing officer was referring to the 2006 decision, Clerk of GA 7 v. FOIC. That decision expanded the definition of "adjudicative" records to include simple docket sheet data which would become not subject to FOIA. The hearing officer attests @ 27:35 that he needs no coaching on the law by Mr. Nowacki because he's a professional 22 years on FOIA Law. Yet...

Clerk has nothing to do with the Nowacki case because Nowacki is not asking for anything to do with an individual case and privacy issues. He's asking for information on Public Hearings. The Law Tribune writes http://www.ctfog.org/CCFOI/subsite/LTValvoArticle.htm : "Three of the seven justices in Clerk favored test based on the 1988 case of Bar Examining Commission v. FOIC. Notes: Quinn: March 3, 2008: We do believe that administrative function should be defined as including the management of the internal institutional machinery of the court system, accounting, budgeting, personnel, facilities, physical operations, scheduling, record keeping, and docketing." That statement is answer to Officer Perpetua's J. Quinn question at 45:50.

In the 1983 case of Rules Committee v. FOIC, Chief Justice Ellen Ash Peters noted that the state FOI Act applies only to the Judicial Branch "administrative records" and not to "adjudicative records" that might interfere with the courts' critical function of deciding individual cases. Peters narrowly defined "administrative" matters as the "budget, personnel, facilities and physical operations of the courts." However, that was surpassed as shown above in 2008 by J. Quinn's notes which included all that encompasses internal institutional machinery, the point being Administrative acts as acknowledged by society are quite broad.

At the very least, it can be claimed Nowacki's failed FOIA to J. Munro and others about the GAL program and rule-making procedure was discovering the following: to know about records dealing with GAL budget or sponsorship, GAL personnel and even trainees, facilities at Quinnipiac and physical operations of the courts concerning the GAL. AMC "commando programs". After all, those Public Agency programs are physical operations that accommodate the efficient operations of the court, are administrative; and Nowacki is not seeking "adjudicative records" that might interfere with deciding any individual case.

Rules Committee v. FOIC is not so narrow that it limits the breadth of which administrative functions can still be carried out despite Clerk, thus is still under FOIA juris and oversight.

Administrative function should be defined as including the management of the internal institutional machinery of the court system, which must include activity related to Rule-making. Why does Perpetua say different @ 1:21:15 ? Perpetua himself comes under scrutiny for then denying evidence relevance concerning Rule-making 1:15:45 . Judge Lynda B. Munro spearheaded a program aimed at influencing private law firms' hiring and employment practices. This is highly controversial behavior showing impropriety and warranting investigation of a conflict of interest, ethics, and even criminal allegations.

When a judge creates and manages, schedules,and coordinates a program like the GAL (Guardian Ad Litem) or AMC (Atty for the Minor Child) training sessions, a program under great social controversy whether or not it's actually destructive to families, promoted independently by this J. Munro, ... is that or is that not an Administrative function subject to FOIA Commission jurisdiction?

I received the below video as a link. I decided to post it. The subject is of how a felony conviction cripples average people, but not the officially connected who have "worked" for taxpayer dollars. Former Connecticut Governor John G. Rowland took bribes from organized crime figures to kidnap as many children as possible away from Connecticut Families, so he would get freebies and bribes, and organized crime figures could build, maintain, supply, and run facilities such as "Kiddie Max" prisons for kids. Rowland most likely got a year in prison, 10 months to serve because he upset the applecart of the Connecticut Judicial Mafia of Lawyers and Judges, having a power pissing contest, interrupting their power and revenue stream, not because he flagrantly broke laws daily.

After doing time as a felon, "Johnny", as he is know to both US Presidents Bush, whined about not having money, gets out of prison buys a mansion, gets all sorts of speaking engagements, get hired as consultant in the uber corrupt official Waterbury, Connecticut, getting paid a salary of $95,000 a year where he may, or may not, even have to show up, or do any work. On March 18, 2011, the Connecticut Ethics Commission undertook investigation into Chief Family Judge Lynda Munro's alleged unlawful solicitation for "sponsorship" from members of the Connecticut Bar Association for mandated family court directed training for Guardian Ad Litem G.A.L.s held at Quinnipiac University. They dismissed it.

Audience is asked to respond to mnowacki@aol.com as to whether Munro's solicitation of Bar funding for the GAL Program constitutes "making law from her secretive back chambers accountable by some state enforcement agency?

The FOIA Commission claims it has no jurisdiction, not an Administrative Issue as defined by Conn. Supreme Court. (1:06:00 & 1:41:00) The hearing officer was referring to the 2006 decision, Clerk of GA 7 v. FOIC. That decision expanded the definition of "adjudicative" records to include simple docket sheet data not subject to FOIA.

Clerk has nothing to do with the Nowacki case because Nowacki is not asking for anything to do with an individual case and privacy issues. He's asking for information on Public Hearings. The Law Tribune writes http://www.ctfog.org/CCFOI/subsite/LTValvoArticle.htm : "Three of the seven justices in Clerk favored test based on the 1988 case of Bar Examining Commission v. FOIC. Notes: Quinn: March 3, 2008: We do believe that administrative function should be defined as including the management of the internal institutional machinery of the court system, accounting, budgeting, personnel, facilities, physical operations, scheduling, record keeping, and docketing."

In the 1983 case of Rules Committee v. FOIC, Chief Justice Ellen Ash Peters noted that the state FOI Act applies only to the Judicial Branch "administrative records" and not to "adjudicative records" that might interfere with the courts' critical function of deciding individual cases. Peters narrowly defined "administrative" matters as the "budget, personnel, facilities and physical operations of the courts."

At the very least, it can be claimed Nowacki's failed FOIA to J. Munro and others about the GAL program and rule-making procedure was discovering the following: to know about records dealing with GAL budget or sponsorship, GAL personnel and even trainees, facilities at Quinnipiac and physical operations of the courts concerning the GAL. AMC "commando programs". After all, those Public Agency programs are physical operations that accommodate the efficient operations of the court, are administrative; and Nowacki is not seeking "adjudicative records" that might interfere with deciding any individual case.

Rules Committee v. FOIC is not so narrow that it limits the breadth of which administrative functions can still be carried out despite Clerk, thus is still under FOIA juris and oversight.

Federal Judge John M. Walker ran down a New Haven Connecticut cop. Walker wasn't arrested and was not drug or alcohol tested. Killing cops is okay for judges, especially if they're related to Bush.

April Gallop's lawsuit went ahead this week with George Bush's cousin sitting in judgment. He'll play a major part in deciding whether the case goes forward or dies. (http://truthandshadows.wordpress.com)

No, it’s not a joke.

A 9/11 lawsuit against former high officials in the Bush White House is being presided over by a cousin of former president George W. Bush – a shocking and blatant conflict of interest that should embarrass even believers in the official story.

George W. Bush’s cousin, Judge John M. Walker of the 2nd Circuit of the United States Court of Appeals, is part of a three-judge panel hearing the case of April Gallop vs. former vice-president Dick Cheney, former defense secretary Donald Rumsfeld and former chairman of the Joint Chiefs of Staff Richard Myers.

The case has been ignored by the mainstream media in the weeks leading up to it going to court April 5. And most media have ignored the developments concerning the involvement of Judge Walker. One exception is CNBC, which carried an online story with the headline: “Extraordinary Conflict of Interest: Bush Cousin Presides Over Federal Court Case Against Former Bush Administration Officials.” Good for them, but this is an all-too isolated exception. That the story is being kept almost entirely out of the media further reveals that the idea of a free and vigorous press is largely a fantasy.

Gallop, a former U.S. Army executive administrative assistant (with top secret clearance), is suing for damages in connection with injuries she and her newborn son suffered in the supposed terrorist attack at the Pentagon on Sept. 11, 2001. The two were injured when the allegedly hijacked American Airlines Flight 77 supposedly slammed into the building. Gallop and many others in the 9/11 Truth movement contend that explosives were planted inside the Pentagon and that Flight 77 never hit the building.

Gallop says a large explosion caused the ceiling above her to collapse. When she regained consciousness, she made her way, son in tow, through the hole the alleged plane was supposed to have created. She says she never saw any evidence that a plane had hit the building. The government claims that 125 people were killed in the Pentagon and another 89 on the plane.

As I reported in a previous post, the Pentagon has refused to help Gallop with surgeries she and her son have required because of the event. They’ve even tried to stop other agencies like the American Red Cross from helping her, according to David Ray Griffin’s account in his book The New Pearl Harbor Revisited.

Gallop launched the original lawsuit in 2008 alleging that the 9/11 attacks were planned at the highest levels of the U.S. government, and that they were blamed on fundamentalist Muslims as part of a cover story. She claims that there was plenty of knowledge that employees of the Pentagon were in imminent danger, and that had alarms been sounded many deaths and injuries would have been prevented.

The idea that Cheney knew a plane was heading for the Pentagon is supported by the 9/11 Commission hearing testimony of the then transportation secretary, Norman Mineta. Mineta reported to the Commission that Cheney was in the presidential bunker prior to the Pentagon “crash” and was tracking the plane as it approached the Pentagon but not taking action to intercept it.

The original Gallop case was thrown out of court in March 2010. Judge Denny Chin dismissed the suit with prejudice, contending that the complaint was based on “cynical delusion and fantasy.”Chin has since been promoted to the very court now hearing the appeal of his ruling.

Gallop’s lawyer, William Veale, made a motion this week to have Judge Walker disqualified from hearing the case, but this was denied. Also denied was the request for a continuance to appeal the decision.

Walker was chief justice of the Court of Appeals from 2000-2006 and has been serving as a senior member of the court since then. Many researchers into 9/11 will also point out that another Bush cousin, Wirt D. Walker III, was CEO of Securacom from 1999-2002 – the company that handled security for the World Trade Center. The company installed a new $8.3-million security system in the towers between 1996 and 2000.

The sheer arrogance of the perpetrators of 9/11 continues to amaze me. These people clearly believe they can get away with anything. And until enough of us get mad, then they’re probably right.

I truly hope that this latest travesty will be one too many and will backfire on Bush, Cheney, and their criminal accomplices. If it doesn’t, how can we ever take the justice system seriously again?

Just-retired Republican Gov. M. Jodi Rell may soon make a court appearance in Bridgeport -- sort of.

In what observers call a rarity in Connecticut politics, attorneys representing activist and journalist Ken Krayeske, arrested at the ex-governor's 2007 inaugural parade, deposed Rell in March as part of his civil rights lawsuit against the arresting Hartford officer.

They plan to present the videotaped footage of her answering questions about what she witnessed as evidence during the trial, scheduled to begin in U.S. District Court in Bridgeport Wednesday.

"It is generally rare and the law is designed to keep it rare," said Perry Zinn-Rowthorn, the associate attorney general assigned to represent Rell at the time of the deposition.

Krayeske said he was working as a freelance journalist, trying to take photos of Rell in January 2007 when a police officer assigned to the governor's security detail recognized him from a list of potential threats. The detective saw Krayeske -- who was carrying camera equipment at the time -- bike up to the parade route, dismount and run in front of the governor. He was charged with breach of peace and interfering with a police and held on a $75,000 bond until after that evening's inaugural ball.

His arrest set off a firestorm, with critics concerned about the existence of a political watch list and others arguing the police simply did their job protecting a public official from a perceived threat.

A Hartford Superior Court judge dismissed the charges that March. Krayeske subsequently filed his lawsuit for false arrest, unreasonable bond and denial of his rights to freedom of expression, freedom of the press and due process.

Last fall Krayeske's attorneys -- Brown & Welsh P.C., where Krayeske practices commercial law -- made a motion to depose Rell to learn what she observed during the parade and whether she felt threatened.

"We filed in opposition on the governor's behalf ... to prevent her being exposed unnecessarily to inconvenience or distraction," Zinn-Rowthorn said. "The law generally provides governors and other high executive government officials should not be subjected to unnecessary discovery and really only deposed where their testimony is critical to a case."

The court allowed the Krayeske team to submit a limited number of questions about what Rell saw along the parade route for a videotaped deposition of the governor in March, about two months after she left office.

"She sat in a court reporter's office in Florida and read the questions and provided her answers," Zinn-Rowthorn said, adding: "At this point we have no role (in the trial). It's up to the parties who remain to argue whether this testimony is admissible."

Houston Putnam Lowry, one of Krayeske's lawyers, believes Rell's testimony will help his client.

"The police have claimed that Ken Krayeske charged the governor," Putnam Lowry said. "Her testimony is, 'I didn't see much and certainly wasn't concerned about my safety.' "

Attorneys representing the Hartford office and city did not return calls seeking comment.

A handful of lawyers, political staffers and educators contacted by Hearst Connecticut Newspapers could only anecdotally recall two other court appearances by governors over the past 30 years -- Republican John Rowland for a matter related to a nursing home strike and Democrat Ella Grasso for an election dispute.

Rell could not be reached for comment.

I believe that the cops, courts, and US Government is corrupt regarding justice, the drug trade, and any US Constitutional protections. A Mexican court convicted Thomas Michael Powell for a drug offense and sentenced him to six years, three months in prison, the term to commence on May 14, 1976, and end on August 13, 1982. Because of 336 days of work credits received by Powell during his imprisonment, the Mexican authorities changed the release date to September 8, 1981. On April 30, 1978, Powell was transferred to the United States pursuant to the Treaty between the United States and Mexico on the Execution of Penal Sentences (Treaty).1 On September 22, 1978, the United States Parole Commission paroled Powell. During parole, Powell was arrested and convicted for using a communication device to facilitate the importation of marijuana and was given a new two-year sentence. Based on this conviction, the Parole Commission revoked Powell's parole and ordered that he serve to two years, four months and seventeen days, the aggregate of the new sentence and the parole violation term. The presumptive parole date was extended to March 1, 1982. This order forfeited Powell's Mexican work credits.

In his habeas petition, Powell argued below that the work credits permanently reduced his original sentence, preventing forfeiture of the credits when his parole was revoked. Rejecting the magistrate's recommendation that the Mexican courts should determine the issue,2 the district court granted the writ of habeas corpus and ordered that Powell's sentence be recomputed to restore the 336 days of work credit. Because we find that credits for work performed in a Mexican prison do not effect a permanent sentence reduction but can be forfeited for a parole violation after transfer, we reverse the finding of the district court.

Powell argues that this court cannot reach the issue of the effect of the work credits on his Mexican sentence because the appeal is moot. Because the full term of the sentence imposed by the Mexican court, without considering the effect of work credits, ended August 13, 1982, Powell asserts that a reversal of the district court's decision would have no practical effect. Powell's argument assumes that the time that has passed since his early release as a result of the district court's order of recomputation would be applied to the full term sentence. Yet the Supreme Court has held that "[m]ere lapse of time without imprisonment or other restraint contemplated by the law does not constitute service of sentence." Anderson v. Corall, 263 U.S. 193, 196, 44 S.Ct. 43, 44, 68 L.Ed. 247 (1923). See also Caballery v. United States Parole Commission, 673 F.2d 43, 46 (2d Cir.1982). Therefore, a reversal of the decision of the district court would mean that Powell could be made to serve the time remaining on his sentence at the time of his court-ordered early release. See Gill v. Garrison, 675 F.2d 599 (4th Cir.1982).3

Powell argues that Article V(3) of the Treaty requires that the time that has elapsed since he was released awaiting appeal in this case be credited to his Mexican sentence. Article V(3) provides:

No sentence of confinement shall be enforced by the Receiving State in such a way as to extend its duration beyond the date at which it would have terminated according to the sentence of the court of the Transferring State.

Powell asserts that under Article V(3), the United States may not enforce his Mexican sentence so as to extend it beyond August 13, 1982, "the date at which it would have terminated according to the sentence of the court of the Transferring State." We interpret the Treaty to mean that the date at which the sentence would have terminated is the time of expiration of the six-year, three-month period, not the specific date of August 13, 1982.4 The expiration of that six-year, three-month period would not occur until Powell served the balance of the sentence that remained at the time of his release. As Powell is yet exposed to confinement under the Mexican sentence this case is not moot.

Forfeiture of the Work Credits

Appellants argue that under the Treaty and the implementing legislation, work credits are to be treated as credits in the nature of good time that can be forfeited for parole violations rather than as sentence reductions. The Treaty provides in Article V(2):

Except as otherwise provided in this Treaty, the completion of a transferred offender's sentence shall be carried out according to the laws and procedures of the Receiving State, including the application of any provisions for reduction of the term of confinement by parole, conditional release, or otherwise....

The treatment of work credits after parole revocation is not "otherwise provided" for in the Treaty, so the laws of the United States apply.5

The Treaty's implementing legislation treats foreign work credits as good time credits. 18 U.S.C. Sec. 4105(c)(1) provides that "all credits for good time, for labor or any other credit" given by the transferring country shall be combined with good time credits subsequently awarded by the United States to provide a release date for the offender under 18 U.S.C. Sec. 4164. This court has held that good time credits do not reduce the sentence imposed by a court; rather, "good time is a conditional right that may be forfeited upon violation of the conditions of the prisoner's release." Frierson v. Rogers, 289 F.2d 234, 235 (5th Cir.1961). See also Granville v. Hogan, 591 F.2d 323 (5th Cir.1979); Lambert v. Warden, 591 F.2d 4 (5th Cir.1979). As work credits are treated like good time credits under the implementing legislation, they, too, are forfeitable.6 18 U.S.C. Sec. 4105(c)(4) provides that "[a]ll credits toward service of the sentence, other than the credit for time in custody before sentencing, may be forfeited as provided in section 4165 of this title...." Section 4105(c)(4) is not directly applicable to Powell because Sec. 4165 refers to forfeiture of credits for violations of the rules of the institution during the time of imprisonment, but it nonetheless demonstrates that the congressional interpretation of the Treaty was that work credits be considered an early release measure in the nature of good time credits, not immutable sentence reductions.

Powell relies on Article VI and Article V(3) to support his argument that the Mexican work credits effected a permanent sentence reduction that cannot be changed by United States authorities. Article VI provides:

Powell's argument proves too much. Both articles refer to the "sentence of the court." Powell's work credits were not part of the sentence of the court of Mexico but were administratively awarded credits for early release from his sentence. Likewise, the Mexican sentence computation document, which sets the release date as September 8, 1981 because of the work credits awarded, is an administrative, not a court document. The work credits recorded in that document are not evidence of modification of the judicially imposed sentence.7 Powell's original sentence will "terminate[ ] according to the sentence of the Court" when he has served the six years and three months required by that sentence. As the work credits awarded him did not permanently reduce that sentence but were subject to forfeiture upon parole violation, the judgment of the district court is REVERSED.

Under the Treaty a citizen of the United States, convicted of a criminal offense in Mexico, is permitted to transfer from Mexican to American custody for the balance of the sentence provided certain conditions are met. A youth offender committed under section 5010(b) of this chapter shall be released conditionally under supervision on or before the expiration of four years from the date of his conviction and shall be discharged unconditionally on or before six years from the date of his conviction.

Notwithstanding the reference to unconditional discharge six years from the date of the conviction, such sentences are interrupted and their termination dates correspondingly postponed when the committed youth offender is not actually serving the sentence. Klein, 572 F.2d 1379 (9th Cir.1978) (escape from confinement); United States v. Marshall, 532 F.2d 410 (5th Cir.1976) (civil contempt sentence); Frye v. Moran, 302 F.Supp. 1291 (W.D.Tex.1969), aff'd without ruling on issue, 417 F.2d 315 (5th Cir.1969) (bail pending appeal).

Article VI(7) of the Treaty distinguishes between the sentence computation document and the document recording the sentence of the court and modifications thereof. That article provides:

The Transferring State shall furnish the Receiving State a statement showing the offense of which the offender was convicted, the duration of the sentence, the length of time already served by the prisoner and any credits to which the offender is entitled, such as, but not limited to work done, good behavior or pretrial confinement. Such statement shall be translated into the language of the Receiving State, and duly authenticated. The Transferring State shall also furnish the Receiving State a certified copy of the sentence handed down by the competent judicial authority and any modifications thereof.

Top Secret Military Specialist April Gallop saw disturbing things up close that have not been reported in the media.

On the morning of September 11, 2001, she was ordered by her supervisor to go directly to work at the Pentagon, before dropping off her ten-week-old son Elisha at day care.

Amazingly, the infant was given immediate security clearance upon arrival.

The instant Gallop turned on her computer an enormous explosion blew her out of her chair, knocking her momentarily unconscious.

Escaping through the hole reportedly made by Flight 77, she saw no signs of an aircraft -- no seats, luggage, metal, or human remains. Her watch (and other clocks nearby) had stopped at 9:30-9:31 a.m., seven minutes before the Pentagon was allegedly struck at 9:38 a.m.

The 9/11 Commission reported that "by no later than 9:18 a.m., FAA centers in Indianapolis, Cleveland, and Washington were aware that Flight 77 was missing and that two aircraft had struck the World Trade Center."

Why then were there no anti-aircraft defenses, Gallop asks, or alarm warnings inside the Pentagon?

Gallop was briefed by officials not to tell her story in public; she also received an email from a Fox News reporter who had been told by the Pentagon not to interview her.

Gallop now believes that officials within the Bush Administration conspired to destroy the Twin Towers of the World Trade Center and WTC 7 -- the third building brought down at 5:20 p.m. that day -- with pre-placed explosives detonated after the planes hit.

On April 5th, 2011, at 11 a.m., at the Federal Courthouse at 141 Church Street in New Haven, Connecticut, the case of Gallop v. Cheney, Rumsfeld, and Myers will be heard by the United States Court of Appeals for the 2nd Circuit.

Gallop's case relies on virtually all forms of evidence admissible in court, but significantly, on published scientific evidence that residues of these explosives were found in the rubble after the attacks. In its totality the proffered case establishes that the government hypothesis -- that the buildings collapsed due to fire in combination with the airplane impacts -- is scientifically untenable.

In addition, Ms. Gallop will, through photographic and other physical evidence, as well as the testimony of a multitude of military and civilian survivors, demonstrate the impossibility of her having lived through the attack on the Pentagon if it had taken place as the government and the defendants claim.

German Federal Judge, Deiter Dieseroth, stated in December 2009 that:

"No independent court has applied legal procedures to review the available evidence on who was responsible for the attacks."

Also, that "it is not acceptable for a constitutional state...to declare war, bomb a foreign country, and place it under military occupation," without first identifying suspects.

Dieseroth also said the U.S. "was under burden of proof" that Osama bin Laden was responsible for the attacks, yet the FBI admits it has no evidence presentable in court to back this up.

Siting Council Chairman Resigns After Accusation of Improper Communication (WEB FIRST)

HARTFORD — The Connecticut Siting Council’s chairman, facing accusations of improper communication, resigned from his seat just one day after public hearings on the proposed Colebrook wind turbines concluded.

Daniel Caruso resigned from the council Thursday, as noted in a press release from Governor Dannel Malloy’s office. The chairman also serves as a probate judge in Fairfield, and according to a letter from Save Prospect attorney Jeffrey Tinley to the Connecticut Siting Council’s executive director Linda Roberts, Mr. Caruso inappropriately discussed BNE Energy’s proposal for wind turbines in Prospect during this line of work.

“Judge Caruso said ‘They’re all nice people. But it’s a lot of b---‘,” Mr. Tinley wrote in the letter. “He then posed a rhetorical question, with words to the effect: The fact that some little town in Massachusetts decides to push these things back 3,000 feet, why should we care about that?”

“He said we are going to do what we have to do,” continued Mr. Tinley.

Save Prospect formed in reaction to a proposal by BNE Energy to build three wind turbines in town. The project would be similar to either half of a pair of proposals in Colebrook, and BNE Energy’s proposals have run into similar opposition. The ex parte communication lasted no more than three minutes, in Mr. Tinley’s estimation, and related to the proceedings at evidentiary hearings in Prospect, namely the line of questioning toward Save Prospect’s president. Save Prospect had invited, in Mr. Caruso’s words, “those people from Massachusetts” to speak at the March 15 evidentiary hearing.

“He said that we (the Siting Council) come up against objections all the time and we always try to listen to the concerns of opponents and take whatever steps can be taken within reason to mitigate adverse impacts,” Mr. Tinley wrote.

Mr. Tinley was present in Fairfield Probate Court on March 18 for an unrelated case, involving the Garofalo estate, along with his partner at his law firm and other attorneys. Mr. Caruso called Mr. Tinley into his chambers after the hearing concluded, “saying something to the effect of ‘Are we’ or ‘how are we’ going to get this done by March 31,” the last day of evidentiary hearings on the Prospect petition.

“I again tried to deflect the issue by stating that whenever a judge tells me that he is interested in hearing something, I take it seriously,” Mr. Tinley wrote. “Judge Caruso said that wasn’t the point; he said that it was important we understand in this context how the Siting Council operates.”

Mr. Tinley also stated Mr. Caruso accused Save Prospect’s noise expert of “pooh-poohing” a question regarding mitigating the noise of turbines, adding, “He said that it wasn’t very smart for a witness who is asked a question by the Chair to ‘pooh-pooh’ it.” The proposed turbines in Prospect and Colebrook would be the first of their kind in the state and have prompted several reactions; one proposed bill would direct the Connecticut Siting Council, along with other state agencies, to adopt regulations regarding wind turbines before any could be built.

“I knew that the Siting Council had publicly taken a position against wind specific regulations and that a Siting Council representative had listened to the testimony and had testified at the legislative hearings on this subject,” Mr. Tinley wrote in the letter. “Judge Caruso said that regulations were not necessary and brought the subject back to the hearings, reiterating that the process was not going to stop and would be finished before anything is finished in the legislature.” Continued...

State Police Want Superior Court Judge Arrested in Connection With Salisbury Case (WEB FIRST)

SALISBURY (AP) — Connecticut State Police have applied for a warrant to arrest a Superior Court judge for coercion and hindering a criminal investigation in Salisbury.

The Republican-American newspaper reported Thursday that Judge Corinne L. Klatt has declined to sign an arrest warrant application targeting a Salisbury man accused of attacking a man who was communicating with his former girlfriend in November unless she receives an arrest warrant for the victim.

Salisbury Resident Trooper Mark Lauretano now wants the judge arrested, saying her actions amount to “coercion and a violation of criminal law.”

The newspaper reports that Judge Klatt declined to comment in Litchfield’s Bantam Court or say why she refused to sign an arrest warrant application for the man singled out by police as the assailant in a fight at the West Main Cafe in Salisbury.

A call to Troop B headquarters confirmed that a warrant had been drawn up but was as yet unsigned.

The SEC today amended its complaint against Francisco Illarramendi, a Stamford, Conn.-based investment adviser, and his firm MK Capital Management LLC, to additionally charge them with engaging in a multi-year Ponzi scheme involving hundreds of millions of dollars. The SEC previously obtained an asset freeze against them in January, alleging that they had misappropriated at least $53 million in investor assets.

In a parallel action today, the U.S. Attorney’s Office of the District of Connecticut unsealed criminal charges against Illarramendi for the same misconduct as well as for obstruction of justice for deliberately misleading the SEC staff during its investigation.

The SEC alleges that Illarramendi and MK Capital Management – which is not registered with the SEC – have misappropriated investor assets and misused two hedge funds they manage for Ponzi-like activity in which they used new investor money to pay off earlier investors. During the SEC’s investigation in December 2010 and January 2011, Illarramendi attempted to hide the fact that his hedge funds were missing assets by providing the SEC staff with a false letter from an accountant in Venezuela that purported to verify the existence of approximately $275 million in assets held by one of the funds. Those assets do not exist.

Since the filing of the original complaint on Jan. 14, 2011, the U.S. District Court for the District of Connecticut entered an order on Jan. 28, 2011, freezing the assets of Illarramendi and his firm. On Feb. 3, 2011, the Court appointed a receiver in the case.
